Hiring an employee who works from home in another State should trigger a local compliance review. It does not support an automatic conclusion that every employee's residence is a separately registrable branch, or that no local establishment can exist without a conventional office lease.
Separate two questions. First, does the employer carry on a covered establishment at a place in that State? Second, which employment protections and other obligations apply to the person working there? An answer to the registration-location question does not necessarily answer the employee's entire legal position.
This guide is reviewed for 18 October 2026 and uses Maharashtra, Karnataka and Delhi as examples. Their definitions, thresholds, exemptions and current amendments differ. There is no all-India Shops certificate that can be assumed to cover every place where the employer's people work.
Describe the arrangement before calling it a branch
A remote employee might choose to work at a personal residence, retain control of the space and move between locations without the employer using any address publicly. Another arrangement may give the employer a dedicated room, signage, access rights and a place to meet customers. A third may involve several employees working together from premises organised and controlled by the company.
These are materially different facts. A label in an employment agreement, such as “remote”, “home office” or “branch”, should agree with the operation rather than replace the assessment.
Prepare a location sheet identifying the employee's actual work address, start date, expected duration, activities, equipment and any business use of the premises. State who chooses the location, whether the employer can require work there, who has access and whether the residence is used for other business functions.
Do not assume that the absence of rent paid by the company resolves the matter. Equally, an employee using a company laptop at home is not, by that fact alone, a complete description of an employer-controlled office.
Separate residence, controlled workspace and operating branch
Use the following comparison to identify issues requiring attention. It is a practical intake tool, not a statutory three-category exemption scheme.
| Arrangement | Facts requiring examination | Supporting records |
|---|---|---|
| Employee-controlled residence | Personal choice, individual work and limited employer use | Remote-work terms and location confirmation |
| Dedicated employer-used home workspace | Access, control, allocation of space and business functions | Occupancy arrangement, approvals and equipment records |
| Regularly staffed local operating location | Common workplace, management, customer activity and records | Site details, staff roster and operating instructions |
| Address used only for correspondence | Whether any work is actually carried on there | Mail agreement and actual work-location explanation |
| Mobile or frequently changing work locations | Where the business function is organised and performed | Travel pattern and approved location history |
The more the facts resemble a deliberately organised business location, the less useful it is to rely solely on the employee's private tenancy or a remote-work label. Record the full arrangement and take a State-specific view.
Maharashtra: broad business coverage and a filing split
Maharashtra's establishment definition covers a broad range of business, professional and connected activities. The shop definition also includes connected offices and workplaces. A home-based arrangement therefore requires an activity and premises assessment; residential use alone is not a complete exemption analysis.
If a covered establishment exists, registration and intimation are distinct routes. The current published consolidated text and signed April 2026 administrative material use the ten-worker distinction. The October 2025 ordinance used twenty. An establishment in the ten-to-nineteen range facing conflicting records should obtain written direction rather than select a convenient threshold.
The April 2026 material also addresses conditional relief involving actual OSH Code registration and the operative rules position. Code enactment or a pending application is not the same as satisfying that relief. Establish which establishment the issued registration covers before relying on it for a remote location.
This does not decide whether one particular home is a Maharashtra establishment. It shows why a company should first determine the local establishment facts and then identify the correct filing position. Do not register a fictional office or omit a real operating location merely to fit a familiar head-office workflow.
Karnataka: office work can matter without a shopfront
Karnataka's commercial-establishment definition includes specified commercial and administrative services involving office work. Its shop definition reaches business or customer-service premises and connected offices and storage. A business need not sell goods over a counter for the statutory question to arise.
Assess the actual area of operation and any relevant territorial application, exclusion or notification. The employer's registered office in another State does not itself answer the position of a Karnataka workplace.
The September 2026 amendment creates an exemption for establishments employing ten or more workers already registered under the OSH Code. It also changes registration validity so that registration once made continues until closure or cessation. These provisions should not be converted into a remote-worker exemption or a rule that a single head-office certificate covers every address.
For a home arrangement, identify the business function carried on there, control over the location and the establishment, if any, to which the employee is attached. If an existing Karnataka record is involved, check its particulars and the scope of any registration relied on before deciding whether correction or another filing is needed.
Delhi: premises and the operative 2026 amendment
Delhi's commercial-establishment definition focuses on premises where business, a profession or connected work is carried on. Its shop definition also includes connected offices and workplaces. That wording requires examination of what occurs at the residence; it does not justify treating every residential address as irrelevant.
Delhi Act 03 of 2026 introduces a twenty-employee application threshold but requires a separate appointed commencement notification. Assent on 23 February and publication on 11 March do not themselves establish commencement. The required commencement instrument was not located in the materials checked for this guide.
Before relying on that threshold for a small local arrangement, establish the operative date and departmental treatment for the relevant period. Avoid declaring that a one-person home office became exempt merely because the amendment was published.
Delhi's registration declaration also concerns the establishment functioning from premises in the applicant's legal possession. Do not declare possession merely because an employee lives there. Examine what right the employer actually has and what the application requires. Registration does not separately authorise residential land use or override a private agreement.
What control and customer use can show
Ask whether the employer can enter the workspace, require its continued use, allocate it to others or direct the employee to maintain it as an office. Identify who pays for the premises and whether the payment buys occupancy rights or merely reimburses personal expenditure.
Customer use deserves particular attention. Is the address on business cards, websites, contracts or invoices as a local office? Are meetings held there regularly? Are goods received or dispatched, company records maintained or other employees supervised from the location?
These facts can support a conclusion about how the business operates. They are not independent numerical tests or statutory safe harbours. A home-office allowance does not automatically establish possession; an absence of a signboard does not prove that no business is carried on.
Where the employer holds the location out as its branch, its registration explanation should address that representation. If an address was published accidentally or only for correspondence, correct the public information and preserve the explanation instead of ignoring the inconsistency.
Count people only after identifying the relevant establishment
A threshold calculation is not useful until the establishment being assessed has been identified. Five people in five employee-controlled residences raise a different factual question from five people directed to work together from one room hired by the company.
Do not automatically aggregate every employee anywhere in India into a local premises count, or automatically isolate each person to stay below a threshold. Identify the applicable legal counting unit, worker or employee definition, relevant period and any branch connection.
Explain direct, contract, part-time, managerial and other personnel according to the State law. A payroll label or reporting line may be relevant evidence, but it does not replace the statutory definition. Where the organisation is distributed and the correct counting unit remains disputed, put that question expressly to the authority.
Preserve the dated roster and reasoning. A growing remote team may change the facts even when the company has not taken a new commercial lease.
Employment protections remain a separate workstream
Do not treat “no separate local registration” as a complete employment-law opinion. Review wages, working time, leave, holidays, workplace protections, employment records and other applicable requirements on their own legal basis.
An employment contract naming the head-office State does not, without further analysis, displace mandatory law that applies to the actual employment. Similarly, keeping payroll and attendance centrally does not itself determine territorial coverage or eliminate the need to produce records where lawfully required.
The review should identify which rules are being followed, the legal basis for that position and how the employer will implement them for the remote employee. Different statutes can use different connecting factors and definitions. Avoid promising that one registration conclusion settles professional tax, social security, corporate or local-body questions.
The central labour Codes also have their own registration and transition requirements. Examine any State relief specifically and preserve the issued document and conditions relied on. Similar terminology across systems does not make the documents interchangeable.
Use a focused escalation path where guidance is incomplete
The official materials checked do not establish a universal remote-home exemption or a single binding answer covering every arrangement in these three States. Do not replace that gap with an unsupported statement that “all remote homes must register” or “home working never needs registration”.
Prepare the factual note, State definitions, current amendment analysis and existing registrations. Ask the competent local Labour Department authority whether the disclosed arrangement constitutes an establishment requiring registration, intimation, amendment or no separate filing under that scheme.
State the precise issue: for example, one employee at a self-controlled residence, no customer access and no employer occupancy rights; or a dedicated room used by a local team with employer access and customer meetings. Ask how the relevant workforce is to be counted if that affects the answer.
Keep the submission, attachments, acknowledgement and response. An unanswered query is evidence of an inquiry, not an exemption certificate. Escalate through the department's appropriate channel where a decision is required, and record the interim arrangements adopted on professional advice.
Review changes before the employee moves
Require employees to notify the employer before a change of work State or a material change in approved premises. This is a recommended control, not a universal statutory notice period. It allows the business to reassess applicable requirements before the new arrangement begins.
Review when customers start visiting, additional employees join, stock is stored, a dedicated room is taken or local management functions expand. Also review when the company closes its leased office and distributes work among homes. Closing the office and resolving its certificate are separate from assessing the new locations.
Keep the original assessment and subsequent versions. The file should explain why the conclusion changed when the facts changed, rather than retrospectively describing every arrangement as the same.
A practical remote-hiring checklist
- Record the actual address, work State, commencement and expected duration.
- Describe the business function, control, possession and customer use.
- Identify any existing local establishment and issued registration.
- Assess the State definition, territorial position and current amendments.
- Resolve the correct worker count, filing route and specific exemption conditions.
- Review employment protections and other statutes separately.
- Obtain a focused authority response where the factual boundary is unresolved.
- Retain the conclusion and trigger a new review when circumstances change.

Frequently asked questions
1. Does one remote hire automatically create a branch?
Not as a universal conclusion. Assess the actual local operation, premises and State law. The hire is a reason to review the position, not a substitute for that review.
2. Does no company lease mean no establishment can exist?
No such automatic conclusion follows. Explain the rights and business use actually involved. A conventional lease is one form of evidence, not the entire statutory analysis.
3. Does a home-office allowance settle the question?
No. Identify what the payment covers and whether it gives the employer occupancy or control rights. General reimbursement and a dedicated business-premises arrangement may involve different facts.
4. What if several employees work from one residence?
Review the common workplace, employer organisation, control and activities. Do not describe a regularly organised local team as unrelated individual work merely because the property is residential.
5. What if everyone works from different homes?
Document each arrangement and the establishment connection. Avoid automatic aggregation or automatic separation without considering the relevant statutory unit and actual business structure.
6. Is the head-office certificate valid throughout India?
Do not treat it as an all-India Shops registration. Identify the premises and establishment it records, then assess the separate position of other operating locations.
7. Does paying salary from head office determine coverage?
Not by itself. Payroll administration is relevant context, but the actual work and applicable territorial and establishment provisions require their own assessment.
8. Can the employment agreement select the only applicable State law?
Do not assume a contractual clause overrides mandatory law. Review the actual employment and statutory connecting factors before reaching a conclusion about employee protections.
9. Does an employee moving States require another review?
Yes. Reassess the new location, activities and applicable law before approving the move where practicable. Update the factual file and any required records or filings.
10. Do client meetings at home matter?
They can be significant evidence of business use. Record their frequency and purpose along with possession, public address use and other facts rather than treating meetings as an isolated automatic test.
11. Is a laptop enough to make a home an office?
It is not a complete factual or legal analysis. Explain the broader arrangement, including employer use of the premises and the work carried on there.
12. Does Maharashtra require only full registration?
Its published framework distinguishes registration from smaller-establishment intimation. Establish the applicable route and resolve the stated threshold transition where it affects the particular record.
13. Is Karnataka's continuing validity a remote-work exemption?
No. Certificate duration and whether a local establishment requires registration are different questions. Check the actual establishment and any specific exemption separately.
14. Does OSH registration automatically replace every State Shops filing?
No universal substitution should be assumed. Apply the particular State provision or direction, its conditions and the scope of the actual issued registration relied on.
15. Is Delhi's twenty-employee amendment operative merely from publication?
Its separate commencement requirement must be addressed. Establish the applicable instrument and period before relying on the new threshold for the remote arrangement.
16. Does residential registration authorise commercial land use?
No automatic permission follows from Shops registration. Review occupancy, owner consent, building and local-use requirements separately where relevant to the proposed arrangement.
17. What if no clear official remote-work answer is available?
Submit the precise facts and legal question to the competent authority and retain its response. Avoid issuing a categorical exemption declaration based only on general internet advice.
18. Is an unanswered departmental query proof of exemption?
No. Preserve it as part of the inquiry history and follow up through the appropriate channel. It does not itself establish a favourable decision.
19. Can closing the leased office cancel its registration automatically?
Do not assume that result. Resolve the old establishment record through the applicable procedure and separately assess the new work arrangements and locations.
20. What should the adviser keep after completing the review?
Retain location facts, agreements, workforce analysis, current legal basis, authority correspondence and the final conclusion. assureOffice's related practice workflow does not replace that evidence or the statutory decision.
