Assam Shops Registration and 365-Day Opening Permission: Are They the Same?

An establishment record and permission to operate on a particular calendar answer different questions. Assam’s older online services listed Shops registration and a separate 365-day opening licence. Employers should not assume that renewing one document renewed the other. However, a current review must also account for the newer Assam legislation and its September 2026 amendment, rather than treating those older services as the complete law.

The current statutory framework allows a shop or establishment to work on all days of the week subject to employees receiving the required weekly rest. That is materially different from the older service description of a licence exempting a shop from a compulsory weekly closure. A business planning daily opening should establish its present statutory position and any applicable restriction, then build a lawful staffing rota.

Read the legislative timeline correctly

The Assam Shops and Establishment Act, 2022 was published as Assam Act III of 2025 after Presidential assent in March 2025. Despite the year in its title, it should not be described as a law necessarily operating from 2022. Its commencement clause states that it comes into force at once.

The 2022 Act repeals the 1971 Act and preserves earlier instruments and registrations to the extent they are consistent with the new law and not superseded. This explains why an old permission can remain relevant to a particular record without making every old service description the current statutory rule.

An amendment titled 2025 was published in February 2026. A further substantial amendment, Assam Act XVII of 2026, was published on 2 September 2026 and also comes into force at once. It changes terminology and the registration architecture, including omission of section 6 and substitution of the smaller-establishment intimation provision.

A current article saying that every Assam establishment must obtain the old registration and then pay for the historical 365-day exemption would therefore be incomplete. Establish the operative version, saved records and present administrative instructions before selecting a service or paying an old fee.

What the old 365-day licence did

The older departmental service page describes a licence for shops with twenty-one or more employees, granting exemption from section 11 of the 1971 Act through its exemption power. It lists a ₹50,000 charge. The same older service system separately lists registration renewal and opening-licence renewal.

Those facts explain the historical distinction, but they should not be presented as an unquestioned current eligibility threshold and fee for every Assam business. The page’s substantive service description is dated March 2024 and expressly relies on the repealed Act. A recent website footer does not turn its old statutory explanation into a newly issued exemption order.

If a business already holds such a licence, collect the full document, its conditions, expiry and later renewals. Determine whether any condition continues to affect the particular establishment under the savings framework or another valid order. Do not destroy the document or assume it has no evidential value merely because the legislation changed.

Conversely, an establishment without an old licence should not be told that it must purchase one solely because the legacy service remains listed. Ask which current provision or operative order requires the proposed filing. The answer must address the present law and actual establishment, not just the existence of a payment screen.

Use the present all-days provision

Section 15(2) of the newer Act permits a shop or establishment to work on all days of the week, conditional on each employee receiving at least twenty-four consecutive hours of weekly rest. The September 2026 amendment revises section 15’s heading and terminology and substitutes its shift-working subsection; it does not remove that all-days provision.

This allows the establishment’s opening calendar to differ from each employee’s working calendar. A shop can serve customers on Sunday while an employee has Tuesday as their weekly holiday, provided the applicable statutory requirements and any binding arrangements are satisfied.

Do not convert “may work on all days” into “may employ every person continuously”. Daily opening does not remove working-hour limits, rest intervals, overtime, leave or safety obligations. Nor does it automatically authorise a twenty-four-hour night operation; opening every day and remaining open throughout every night are different questions.

Check other restrictions relevant to the activity and location, including municipal, excise, fire, public-order and sector-specific requirements. The Shops all-days provision cannot enlarge a separate licence’s permitted hours or override a lawful closure direction.

Registration and intimation have also changed

The September 2026 amendment omits the old registration section 6 and changes the chapter heading to commencement, changes and closure. Its substituted section 7 provides online intimation for establishments employing fewer than ten workers, with the prescribed declaration and documents, and a receipt from the competent Inspector-cum-Facilitator.

The provision uses a sixty-day period linked to commencement of the Act or commencement of business. Its proviso addresses establishments having ten or more employees and provisions not included in the OSH Code. Review the central registration framework and Assam implementation on their own terms rather than assume that an old Shops certificate is the only current establishment record.

These changes do not merge every registration, intimation and operating permission into a single universally renewable document. A portal account, business identifier, intimation receipt and saved opening licence can remain distinct records. Identify what each document legally does and which particulars it covers.

For an existing concern, check how the department wants its old record mapped or updated. Do not submit a second initial record using a new commencement date merely because the interface still displays an old Act title. If the current service does not clearly reflect the amendment, obtain a written routing instruction.

Build a rota before announcing daily opening

List the employees, their duties, normal working hours, weekly rest and cover arrangements. Check the rota over actual dates rather than simply assigning a weekly-off label in a spreadsheet. The employee must receive the required continuous rest period, not just a nominal holiday interrupted by work calls or stocktaking.

For example, a seven-day retail outlet can divide staff into groups whose weekly rest falls on different days. The manager should verify that the opening and closing teams can operate without repeatedly calling the same person back during their rest. A rota that relies on everyone being available on every busy day is not a workable weekly-holiday plan.

Record changes when staff swap days. Preserve the request, approval, actual attendance and effect on hours. A swap should not leave an employee without the required weekly rest or conceal overtime. Reconcile the planned rota with attendance and payroll instead of treating the original schedule as proof of what happened.

The Act provides compensatory leave within two months where weekly holiday is denied and special wage treatment for work on the rest day. These provisions should not be used as a routine permission to deny rest indefinitely. Apply the current law, any more favourable entitlement and the actual circumstances, and document the compensation and replacement leave.

Keep overtime, night work and weekly rest distinct

A person can exceed daily or weekly working limits even while receiving one weekly holiday. Conversely, paying overtime does not automatically satisfy the separate rest-day obligation. Review both the time records and payments.

The September 2026 amendment provides overtime wages at twice the applicable rate, with daily or weekly calculation whichever is more favourable to the employee, and employee consent for overtime. Apply the relevant definition of wages and current working-hour provisions; do not simply multiply a convenient basic-pay figure without checking the legal basis.

Night work also requires a separate review, particularly for women employees and applicable safety, consent and transport conditions. The February 2026 amendment changed the relevant gender and night-work framework. A general all-days opening statement does not itself prove compliance with those conditions.

Keep appointments, identity records and safety arrangements aligned with the actual staffing. A small establishment should not assume these questions disappear because its commencement is recorded by intimation rather than the older registration procedure.

Handle old permissions and renewals accurately

Create a document register showing the old registration, any renewed certificate, opening licence, current intimation or central registration, and other activity permissions. Record each number, legal basis, premises, employer, conditions and expiry where applicable.

If an old opening licence has an expiry date, ask how its current treatment follows from the new law and any saved order. Do not assume renewal of an establishment record automatically renews it. Equally, do not pay a legacy licence renewal without establishing why that separate permission remains required for the present operation.

The official e-services list and EODB system remain useful entry points, but service names should be checked against the enacted legislation. A published auto-renewal heading, without detailed current eligibility or validity instructions, is not evidence of a universal renewal period.

A move, employer change or additional branch also needs review. An old permission naming one employer and premises should not be treated as automatically covering a new company or another address. Obtain the appropriate update, recognition or replacement direction and retain the resulting record.

Prepare an operating-permission file

The file should contain the activity and premises description, workforce list, legal-version note, current establishment record, any old licence and written departmental clarification. Add weekly rotas, actual attendance, overtime consent and payment records, rest-day arrangements and relevant safety documentation.

If the department still directs a separate opening application, ask for its current legal basis, eligibility, self-certification requirements, fee, validity and renewal conditions. Supply accurate particulars through the designated service and preserve the application and output. Do not infer permission merely from an acknowledgement or payment receipt.

Review conditions before a major staffing or operating change. A plan to extend from six days to seven, or from daytime trading to overnight operation, should trigger a separate check. These are practical management controls; they should not be misdescribed as a newly invented statutory filing in every case.

assureOffice readers can use this distinction when organising a client’s establishment and workforce records. A discussion through assureoffice.in should specify the legal review and documents required, without promising an Assam permission-application or automatic-renewal service.

Frequently asked questions

1. Are registration and 365-day permission the same document?

Historically they were separate services, and renewal of one should not be assumed to renew the other. The current legislation also changes the registration framework, so identify each document’s legal purpose and present treatment before filing.

2. Does the present Act allow opening every day?

Section 15(2) permits all-days operation subject to employees receiving at least twenty-four consecutive hours of weekly rest. Check other applicable restrictions and conditions. Daily opening does not authorise continuous work by each employee.

3. Must every registered shop close on Sunday?

Do not import a universal Sunday-closure rule. Apply the present all-days provision, weekly-rest requirements and any specific binding order or entitlement. Employees’ rest days can differ from the establishment’s opening calendar.

4. Is the old twenty-one-employee licence threshold current for everyone?

The legacy service description uses that figure under the 1971 Act. It should not be presented as the complete current rule after the newer legislation and amendments. Establish the present legal basis before relying on it.

5. Should I automatically pay the old ₹50,000 fee?

No. First establish whether a separate licence is currently required for the establishment and the operative fee instrument. The figure on a March 2024 service description is not by itself proof of a current compulsory charge.

6. Why do official pages still mention the 1971 Act?

Some service descriptions predate the replacement legislation. The newer Act also has savings for consistent earlier instruments. Read the actual current law and particular saved document rather than treating every old heading as current law.

7. Was the 2022 Act necessarily effective in 2022?

Do not infer that from its title. It was published as Assam Act III of 2025 after Presidential assent in March 2025 and contains an at-once commencement clause. Titles and publication histories need to be distinguished.

8. What changed in September 2026?

The enacted amendment substantially revises the framework, including omission of section 6 and smaller-establishment online intimation under section 7. It also updates terminology and employee protections. An older registration-only guide is incomplete.

9. What applies to establishments with fewer than ten workers?

The substituted section 7 provides prescribed online intimation with supporting declarations and documents, and an official receipt. Use the current designated route and check how an existing legacy registration should be handled.

10. Is an old Shops certificate automatically an OSH registration?

Do not assume equivalence from similar identifiers or the amendment’s reference to the central Code. Apply the actual registration and recognition provisions and confirm the record’s mapping through the competent authority.

11. Can each employee take a different weekly holiday?

A staggered rota can support daily opening if every employee receives the required rest and other applicable entitlements. Check actual attendance and continuous rest periods rather than relying solely on the labels in the planned schedule.

12. Can weekly rest be interrupted for a short stock check?

That can affect whether the required continuous rest was actually provided. Record the work honestly and assess the resulting rest, payment and compensatory-leave obligations. Do not describe an interrupted holiday as uninterrupted merely because the work was brief.

13. Does paying overtime remove the need for weekly rest?

No automatic substitution follows. Hours, overtime and weekly rest are separate requirements. A compliant payroll calculation does not itself establish that the employee received their required holiday or replacement leave.

14. How soon is compensatory weekly leave provided?

The all-days framework provides compensatory leave within two months where weekly holiday is denied. Apply the actual conditions and any more favourable entitlement. Do not use it to plan indefinite denial of weekly rest.

15. Is opening seven days the same as opening twenty-four hours?

No. Seven-day opening concerns the calendar; overnight operation raises separate hours, safety and sector-permission questions. Review the proposed overnight staffing and activity restrictions before extending the opening hours.

16. Does the all-days provision settle women’s night work?

No. Apply the separately amended gender and night-work framework and applicable consent, safety and other conditions. A shop’s opening calendar is not proof that every employee can work every proposed shift.

17. Does auto-renewal mean all old licences renew together?

No. Identify the actual service and document. A heading describing auto-renewal does not establish that another certificate or permission was renewed, or that every legacy permission remains compulsory under the new law.

18. Does permission transfer automatically after relocation?

Do not assume so. Compare employer, premises and conditions with the proposed operation and obtain the correct update or replacement direction. A document for one site should not be treated as covering another without review.

19. What should I do if the portal still offers only old services?

Request written routing from the competent labour authority with the current record and proposed operating facts. Do not invent a new opening date or select an inaccurate transaction solely to fit an old interface.

20. What evidence best supports lawful daily opening?

Keep the current legal basis, establishment record, relevant permissions or clarification, employee rotas, actual attendance, weekly-rest and overtime records. The evidence should show both why the premises may open and how employees receive their entitlements.
