Emigration Remittances under FEMA: USD 250,000, Country Requirements and Investment-for-Points Packages

A migration package can combine permitted incidental expenses with overseas investments requiring a different FEMA analysis. This guide explains ordinary LRS aggregation, documented country-required amounts and the limits of the enhanced emigration facility.

Do not treat an emigration package as an unrestricted permission to remit any amount abroad. Apply the ordinary USD 250,000 financial-year framework, the documented country-requirement exception where available, and the RBI restriction concerning enhanced emigration remittances for investment-based points or credits. Classify the actual expenditure before approaching the authorised dealer.

This guide concerns resident individuals funding emigration and was checked on 24 October 2026. It reads the RBI Other Remittance Facilities direction updated on 1 October 2026 with the LRS direction. It does not determine immigration eligibility, promise overseas investment approval or compute Indian tax collection on remittances.

Two official texts must be read together

Schedule III in RBI’s Other Remittance Facilities direction lists emigration among individual remittance purposes within the ordinary USD 250,000 framework. Its first proviso allows an amount above the LRS limit for specified purposes, including emigration, if required by the country of emigration. Prior LRS remittances in the financial year must also be considered; the exception is not permission to omit the existing history.

RBI’s LRS direction, paragraph A.7(d) addresses the amount prescribed by the emigration country or USD 250,000, and restricts excess remittance to incidental expenses in the immigration country rather than earning immigration points or credits through overseas investments such as government bonds, land or a commercial enterprise. The wider LRS rules also require permitted purposes and compliance with applicable capital-account rules.

Accordingly, obtain the actual country requirement, the applicant to whom it applies, the required amount, the permitted beneficiary and the payment stage. A consultant’s sales quotation describing a premium visa package is not itself evidence of a country-mandated qualifying amount. Distinguish a requirement to demonstrate resources from an instruction actually requiring an overseas remittance.

Separate the package into its legal and payment components

Request an itemised breakdown: governmental or administrative charges, genuine relocation expenses, professional service charges, refundable deposits and proposed investments. Identify the payee and destination of each component. The enhanced emigration facility cannot be justified solely by adding every component into one invoice headed immigration.

Where a package includes an investment for points, remove it from the incidental-expense justification and examine its independent FEMA route. This is not a statement that every overseas investment is forbidden: the investment’s own eligibility, limits, structure and approvals must be assessed. An emigration agent’s assurance does not perform that assessment.

Build one remittance history and a controlled funding request

Maintain an April–March history for the individual across relevant purposes and remitting channels. A different dealer does not create a new individual allowance. Reconcile executed remittances, cancellations, refunds and unexecuted applications using the bank’s records. Do not assume that a refund automatically restores annual remittance headroom without establishing the applicable treatment.

For a supported enhanced request, explain the country-required amount and how earlier payments relate to the same requirement. This prevents requesting the full amount again after funding part of it. Convert foreign-currency requirements into a consistent comparison currency using the actual authorised dealer’s quotation; the arithmetic examples below use hypothetical exchange rates.

RBI’s LRS direction requires the individual to designate an authorised-dealer branch through which all remittances under the Scheme will be made, and prescribes Form A2 documentation and PAN. A proposed change of branch should therefore be addressed with the dealer, not treated merely as another source of annual headroom. Keep the purpose declaration consistent with the actual beneficiary and supporting requirements. The bank may need further evidence to establish the bona fides and permissible route; an article’s sample calculation is not a substitute for that assessment.

Emigration can change the facts for later transactions

Reassess FEMA residential status and the applicable account or remittance framework when circumstances change. A prior resident-individual emigration remittance does not establish perpetual eligibility under LRS after departure. Track money actually sent and money still held in India separately. If unspent funds or refunds arise, determine the applicable retention, repatriation and surrender rules for the person’s actual status and transaction rather than treating the original package budget as expenditure.

Worked illustrations

These illustrations use fictional facts and expressly stated assumptions. Amounts are Indian rupees unless a different currency or unit is specified. They are independent examples, not findings about any actual client.

Illustrative example 1: Ordinary headroom after earlier remittances

Assume the individual has already made USD 80,000 of ordinary LRS remittances in the same financial year and proposes USD 120,000 of otherwise permitted emigration-related expenditure. The aggregate is USD 200,000 and remaining ordinary headroom is USD 50,000. This calculation does not validate the underlying purpose or payee.

Illustrative example 2: A documented requirement above the ordinary amount

Assume the country of emigration genuinely requires a qualifying USD 360,000 remittance and the authorised dealer has established that the enhanced facility applies to these facts. The amount above USD 250,000 is USD 110,000. The supporting country requirement is the basis for analysing that excess; the existence of an agent’s USD 360,000 quotation alone would not establish it.

Illustrative example 3: Avoid funding the same requirement twice

A qualifying country-required amount is USD 320,000. Assume USD 100,000 has already been remitted and accepted toward that same requirement. The remaining requirement is USD 220,000. Sending a further USD 320,000 would produce USD 420,000 in total, an excess funding of USD 100,000 over the stated requirement.

Illustrative example 4: Separate investment from incidental expenses

A package comprises USD 200,000 of assumed genuine incidental expenses and USD 180,000 of government bonds proposed to obtain immigration points. Total package cost is USD 380,000. The USD 180,000 investment component cannot be justified as incidental expenses under the enhanced emigration facility. Assess its separate permissible route; do not present the whole USD 380,000 as qualifying incidental expenditure.

Illustrative example 5: Changing remitters does not reset the allowance

Assume ordinary LRS remittances of USD 90,000 and USD 110,000 have already been executed, and a further USD 60,000 is requested through another channel. Aggregate ordinary usage would be USD 260,000, exceeding USD 250,000 by USD 10,000. An independently established enhanced exception or approval must be examined; the new channel supplies no fresh personal allowance.

Illustrative example 6: Translate a foreign-currency requirement consistently

A documented country requirement is EUR 300,000. At the expressly hypothetical rate of USD 1.10 for EUR 1, its comparison value is USD 330,000, or USD 80,000 above USD 250,000. Obtain the dealer’s applicable actual rate and confirm the requirement and route; this assumed rate is not a current market quotation.

Illustrative example 7: Distinguish unremitted budget from a refund

A supported funding budget is USD 350,000. Only USD 300,000 is actually remitted, and final verified expenditure is USD 280,000 with a USD 20,000 refund arising. The USD 50,000 never remitted is not another refund receivable. Reconcile the actual USD 20,000 and determine its applicable foreign-exchange treatment; do not assume annual headroom is restored automatically.

Sixteen practitioner FAQs

1. Is USD 250,000 a separate allowance for each emigration invoice?

No. Ordinary LRS aggregation is individual and financial-year based across permitted purposes.

2. Can the country-requirement exception exceed the ordinary amount?

Schedule III provides an exception where the country of emigration requires it. Establish the actual requirement and applicable conditions.

3. Does an agent’s package price prove that requirement?

No. Obtain country-level evidence and identify what must actually be remitted.

4. Is showing a bank balance necessarily the same as remitting it abroad?

No. Read the destination’s requirement rather than treating proof of resources as a payment instruction.

5. Can enhanced incidental funding be used to buy bonds for immigration points?

The RBI emigration provision expressly distinguishes excess incidental-expense remittances from investment to earn points or credits.

6. Does that mean every overseas investment is banned?

No. A separate capital-account route may need evaluation. The enhanced emigration rationale alone does not establish eligibility.

7. Can a second bank provide a new USD 250,000 limit?

No. Maintain one individual history; changing channels does not reset the underlying allowance. Follow the designated authorised-dealer branch requirement in paragraph A.15 and resolve a proposed branch change with the dealer.

8. Should earlier payments toward the same requirement be deducted?

Reconcile them so that the remaining funding request does not duplicate the amount already satisfied.

9. May relatives’ limits simply be treated as one unrestricted pool?

No. Any consolidation must satisfy the applicable conditions for each individual and the actual transaction. Do not assume a package creates unrestricted pooling.

10. Are the example exchange rates live quotations?

No. The stated hypothetical rate illustrates conversion; the actual request needs the dealer’s applicable quotation.

11. Does Form A2 itself prove the transaction is permitted?

No. Its declaration and supporting facts must correspond to a permissible transaction.

12. Is PAN relevant to ordinary resident-individual LRS documentation?

Yes. The RBI direction requires PAN for LRS remittances, alongside the prescribed documentation.

13. Does a refund automatically recreate annual remittance capacity?

Do not assume so. Trace the original payment and establish the applicable treatment with the authorised dealer.

14. Is an amount never remitted an overseas refund?

No. Keep the undrawn domestic budget separate from funds actually sent and subsequently returned.

15. Can the same LRS assumption be used indefinitely after departure?

Reassess FEMA residence and the transaction framework as the person’s circumstances change.

16. Does the FEMA amount settle Indian tax collection and reporting?

No. Tax collection, withholding and reporting, where applicable, require an independent assessment under the law relevant to that payment.

Conclusion

Present the authorised dealer with an itemised, evidence-backed emigration request and a complete remittance history. A documented country requirement may support enhanced funding, but an investment-for-points package cannot be treated wholesale as incidental expenditure.
