EPF for Foreign Employees and Overseas Deputations: When Does a Certificate of Coverage Matter?

A certificate of coverage matters when an operative social-security agreement allows an employee to remain in one country’s system during a qualifying international assignment. It is evidence of the applicable coverage, not a general exemption from all employment law. The employer must identify the agreement, employee, assignment, covered legislation and certificate period before changing payroll.

For Indian payroll in 2026, the analysis must also use the replacement EPF and pension schemes. An old international-worker handbook is useful background, but cannot establish that every pre-2026 wage-base rule, exclusion or withdrawal restriction remains unchanged. Nor should a business stop contributions merely because it has read about a court challenge to an earlier scheme provision.

Separate inbound and outbound assignments

An inbound case involves a person coming to work in India. Record passport and nationality, employing entities, Indian establishment, assignment dates, remuneration and existing home-country coverage. A foreign passport can be relevant to the international-worker definition, but it is not by itself a valid detachment exemption.

An outbound case involves an Indian employee working abroad. Record the Indian employment relationship, destination country, host arrangement and whether the person is eligible under an agreement. The 2026 Scheme definition addresses Indian employees with relevant agreement-country work and benefit eligibility; overseas travel alone does not answer that test.

The scheme also contains specific treatment for Nepalese and Bhutanese nationals. Do not place every non-Indian passport holder into one undifferentiated payroll category. A proper assignment sheet distinguishes nationality, residence, employer, treaty coverage and work location instead of using foreign as the entire legal conclusion.

Verify the agreement and its effective date

Obtain the actual bilateral agreement, administrative arrangement and current implementation instructions. Check that it is in force for the assignment period. Signature, parliamentary presentation and commencement are different events. A signed treaty awaiting entry into force does not necessarily permit the same treatment as an operative agreement.

Identify the legislation covered. Some agreements coordinate contribution liability; others also address benefit totalisation or export. Do not promise pension aggregation merely because a certificate prevents duplicate contributions. Health insurance, workplace compensation, immigration and income tax require separate analysis unless the instrument actually addresses them.

Read the relevant detachment conditions: sending employer, ongoing employment, expected duration, covered person and extension mechanism. Nationality may matter differently from residence or previous coverage. A short local hire is not automatically a detached worker, and an intercompany secondment letter does not replace the agreement’s conditions.

A current UK example shows why dates matter

The UK–India contribution agreement and exchange of notes entered into force on 15 July 2026. Its operative detached-worker period uses an anticipated assignment of up to sixty months. Earlier published text used a different period, so a team relying only on the initial signed publication can apply the wrong limit.

For a qualifying Indian-employer posting beginning on or after that date, the worker may remain subject to Indian social-security legislation and obtain EPFO coverage evidence for exemption from UK National Insurance. The agreement has specific transition treatment for people already working abroad immediately before commencement; an assignment should not be assumed grandfathered into the new detachment route.

The corresponding UK-to-India case requires assessment of UK coverage and a certificate through the relevant UK process. Special provisions also address aircrew, mariners and government employees. A generic sixty-month spreadsheet cannot replace those categories. Use this example as a reminder to read the actual agreement for the country concerned, not as a universal rule for every international posting.

Understand what the certificate should establish

Check the employee’s identity, sending employer, destination, applicable legislation, issue reference and start and end dates. Compare them with the actual assignment. A certificate covering another group company or an earlier posting may not establish coverage for the current arrangement.

Retain the application, certificate, home-country contribution evidence where relevant and any authority correspondence. Confirm authenticity through the competent institution’s authorised process if something appears inconsistent. A scan forwarded by a relocation agent should not be the only evidence where its details do not match the employment file.

Document the payroll decision by period. The certificate’s role is to support the legal conclusion that one system continues under the agreement. It does not excuse failing to pay the required home-country contributions, and it should not be treated as proof of compliance with unrelated Indian wage or workplace obligations.

Manage expiry and assignment changes

Set a review before the certificate ends. An extension may require consent of one or both competent institutions and may not be automatic. A pending application is not necessarily an effective renewed certificate. Establish the applicable treatment for any gap rather than assuming the original exemption continues indefinitely.

Review a change of employer, destination, duties or expected assignment length. A permanent local transfer can alter the detachment facts even where the worker remains at the same desk. Keep the commercial approval separate from the coverage decision; a revised assignment letter cannot extend a government certificate by itself.

If the worker returns early, retain the actual return and payroll dates and complete any required notification. If the posting continues beyond permitted coverage, assess host-country entry and home-country treatment promptly. Avoid an unmanaged period in which neither employer pays because each assumes the other country remains responsible.

Apply the replacement Indian schemes carefully

The EPF Scheme, 2026 contains international-worker definitions, membership and retention provisions and agreement-linked exclusions. A qualifying detached worker contributing to the home system under the relevant agreement requires assessment under those provisions. Do not describe every foreign employee from an agreement country as excluded without verifying the actual detachment conditions.

The 2026 contribution paragraph contains a wage-ceiling framework, while specific provisions, including the UK detachment provision, address contributions on total statutory wages. Read those provisions together with the agreement and operative notifications. It is unsafe either to import an old universal uncapped-wage assumption or automatically apply the ordinary domestic ceiling to every international case.

For the UK detachment route specifically, the 2026 Scheme’s paragraph 9(6) identifies total wages under the Social Security Code when seeking the stated detachment benefit. That needs modelling before the employer promises contribution savings. Avoid comparing only the nominal rates while ignoring the contribution base.

Reconcile remuneration paid in more than one country

Collect the Indian payroll, overseas payroll, assignment allowances, bonuses and recharge arrangement relevant to the employment. Identify the remuneration to which the applicable Indian wage definition and scheme apply. Payment abroad does not, by itself, establish exclusion from an Indian contribution calculation.

Do not automatically include every reimbursement or every group-company transfer. Classify the actual employment payment and statutory exclusion using evidence. Distinguish a home-country salary payment from a cost recharge between companies so that the same remuneration is not counted twice.

The 2026 EPF Scheme specifies a currency-conversion basis for non-rupee wages: the State Bank of India telegraphic-transfer buying rate on the last working day of the month for which wages are due. Retain the rate and calculation. A tax conversion rate or the company’s annual budget exchange rate should not silently replace the scheme’s prescribed basis.

Review pension and withdrawal separately

EPF membership, pension membership and eventual withdrawal are separate issues. Obtain prior service, pension records and the agreement’s relevant benefit provisions before promising a payment on departure. A worker leaving India is not automatically entitled to immediate withdrawal on the same conditions as an ordinary domestic employment exit.

The 2026 EPF Scheme has specific provisions for payment of international-worker accumulations, including retirement and incapacity conditions and agreement-related treatment. Apply the actual provision to the worker rather than copying a historical exit note. Keep bank, identity, nomination and treaty documentation ready for the authorised claim process.

An assignment briefing should state what is known about contributions and what later benefit questions require confirmation. Do not describe a contribution-only arrangement as a guaranteed combined pension, or a certificate of coverage as a transferable investment account.

Do not turn litigation into an unsupported exemption

Earlier international-worker provisions have been challenged, and different High Courts have taken different approaches. Jurisdiction, finality of an existing assessment, appeal orders and the precise provision challenged matter. A headline that a court struck down a rule does not establish a nationwide right to stop paying or recover every historical contribution.

The replacement 2026 schemes add another distinction: a challenge concerning the former scheme does not automatically dispose of the current text. Obtain the actual judgment, later orders and advice on its application to the establishment and period. Where an assessment has become final, a later judgment elsewhere may not reopen it through an unrelated proceeding.

Maintain a litigation note identifying the case, operative order, territorial relevance, challenged instrument, period and payroll consequence. Recheck it before implementing a suspension or refund claim. Do not present an unverified appeal status as settled law or assume that a case reference on a vendor slide is a current stay order.

Prepare an assignment compliance dossier

The dossier should connect identity, employment, treaty, certificate, pay and monthly compliance. Include expected and actual assignment dates, home and host employers, country-specific conditions, certificate expiry, contribution base, currency conversion, pension treatment and authorised approvals. Keep immigration and tax workstreams connected while preserving their separate legal conclusions.

assureOffice can sit within the practice’s wider financial and client workflow when coordinating this evidence. The international assignment requires specialist interpretation beyond routine payroll. Information at assureoffice.in should not be taken as a certificate-issuing service or a decision on treaty eligibility.

Frequently asked questions

1. Does foreign citizenship automatically permit the domestic PF ceiling?

No automatic conclusion is safe. Apply the 2026 Scheme, international-worker provisions and any treaty-specific rule. Equally, do not assume the old uncapped treatment applies unchanged. Record the current provision governing the contribution base for the actual worker and period.

2. Is an agreement enough without a certificate?

The agreement’s conditions and required evidence must be satisfied. A country appearing on an agreement list does not prove this employee is detached. Obtain the relevant certificate or competent-institution determination and compare its details with the actual assignment before applying an exclusion.

3. What happens when the certificate expires?

Assess whether a valid extension exists and what law applies after expiry. A renewal application does not necessarily continue coverage automatically. Set a review early enough to obtain the required decision or configure host-country compliance before an uncovered gap develops.

4. Can overseas-paid salary affect Indian contributions?

Yes, depending on the applicable wage and scheme provisions. Examine the employment remuneration across payrolls and avoid double-counting company recharges. The place or currency of payment does not, alone, determine whether the amount belongs in the Indian contribution base.

5. Does every overseas trip make an Indian employee an international worker?

No. Apply the scheme definition and the assignment facts, including the relevant agreement and benefit eligibility. A business visit, local overseas hire and employer detachment can have different consequences. Record the legal category instead of relying on the travel itinerary alone.

6. Are all non-Indian nationals treated identically?

No. The scheme contains specific treatment, including provisions concerning Nepalese and Bhutanese nationals. Agreements can also differ. Check nationality, residence and coverage conditions separately rather than treating foreign passport status as the entire payroll decision.

7. When did the UK–India arrangement become operative?

The agreement and exchange of notes entered into force on 15 July 2026. Use the operative text and transition conditions. Earlier signature or initial publication did not, by itself, establish that the same detachment benefit applied before commencement.

8. Is the UK detachment period universally thirty-six months?

No. The operative agreement with exchange of notes uses sixty months for the relevant anticipated posting. Earlier published text differed. This is also not a universal period for all countries; every assignment needs its own agreement and certificate conditions.

9. Are assignments already underway automatically covered by a new treaty?

Not necessarily. Transition provisions can treat them differently from postings beginning after entry into force. The UK arrangement illustrates this distinction. Compare the actual posting start, existing coverage and commencement provisions before promising a new exemption for an ongoing assignment.

10. Can a group-company transfer preserve the same certificate?

Only if the applicable conditions and certificate permit the changed facts. Examine the employer and detachment relationship and obtain the required authority response. A new group assignment letter cannot, by itself, amend a certificate issued for another legal employer or period.

11. Is a certificate a complete exemption from Indian labour law?

No. It establishes the relevant social-security coverage within its scope. Wages, workplace safety, immigration, tax and other employment obligations need separate analysis. A certificate should never be filed as a general clearance for every legal requirement affecting the assignee.

12. Which exchange rate should Indian PF payroll use?

The 2026 EPF Scheme specifies the SBI telegraphic-transfer buying rate on the last working day of the month for which the non-rupee wages are due. Preserve the rate evidence and calculation rather than substituting a budget or tax rate without authority.

13. Does a treaty always combine pension service?

No. Read the agreement’s covered legislation and benefit provisions. A contribution coordination arrangement does not automatically provide totalisation or a combined pension. Explain the actual benefit scope separately from the certificate which prevents duplicate contributions during a qualifying posting.

14. Can the employee withdraw EPF immediately when leaving India?

Do not promise that automatically. International-worker payment provisions and the relevant agreement may impose specific conditions. Review retirement, incapacity, settlement and treaty rules, plus identity and bank evidence, before describing a departure as an immediately payable final withdrawal.

15. Does an earlier court challenge suspend every current contribution?

No. Obtain the operative judgment and later orders and assess jurisdiction, instrument and period. Conflicting decisions and final assessments require care. A case concerning the former scheme does not automatically invalidate the replacement 2026 provisions or create a universal refund right.

16. Where should litigation status be verified?

Use the court’s actual orders and case record, together with current official administrative directions where relevant. A secondary article can identify a case but should not establish a stay or final outcome. Record the precise payroll consequence supported by the order.

17. What if no social-security agreement applies?

Assess the Indian scheme and host-country law separately. Do not manufacture a detachment exclusion from a foreign contribution receipt alone. The possibility of dual contributions should be evaluated before assignment cost is approved and communicated to the employee.

18. Should a pending certificate be treated as approved?

Not unless the applicable legal procedure supports that treatment. Record the application and obtain the competent institution’s position for the intervening period. Agree a lawful correction plan if retrospective coverage is later recognised rather than assuming approval from silence.

19. What records should remain after the assignment ends?

Retain employment and assignment terms, certificate and extensions, actual travel and return dates, monthly wages, conversion workings, contributions and claim records. Preserve any authority or court decision relied on. These documents support later benefit and historical assessment questions.

20. Can assureOffice decide treaty eligibility?

No such capability should be assumed. assureOffice can form part of the wider financial workflow, while treaty interpretation and the coverage decision require verified documents and appropriate expertise. The certificate must come through the competent institution’s authorised process.
