Use the correct trigger and filing party

Under CGST Rule 138D, a transporter may upload information in FORM GST EWB-04 when a vehicle has been intercepted and detained for more than thirty minutes. Exactly thirty minutes does not meet the wording. The facility is permissive and records detention; it does not itself order release, extend an e-way bill or replace a response to a separate notice.

Capture the actual event

Record when the vehicle was intercepted and when it was actually held, with location, vehicle and shipment references. Preserve driver messages, trip records, officer communications and any written notice, and distinguish actual detention from traffic delay or a voluntary stop. When times conflict, keep both records and explain the discrepancy instead of choosing whichever crosses the threshold.

Submit and preserve the report

The official e-way bill portal manual describes the route as Grievance → Detention Form [04]. Enter the e-way bill number, open the form and save the information submitted and any available reference or acknowledgement. The portal FAQ says the report is routed to the relevant senior GST officer for redress. Keep it connected to the relevant trip. If several consignments share one vehicle, prepare a shipment crosswalk so the event is neither lost nor counted repeatedly in internal reporting.

Track the separate case and release

Record later inspection, notice, payment, order or release on its own timeline. If the officer has inspected the goods in transit, track the officer’s separate Rule 138C inspection report in FORM GST EWB-03 independently of the transporter’s EWB-04 report. Follow any deadlines or directions applicable to those proceedings independently. Check current e-way bill status and any applicable movement requirements before resuming the trip. An EWB-04 submission is not proof of release.

Six worked illustrations

All facts and amounts are fictional. Calculations illustrate the stated assumptions, not a predetermined legal outcome.

Illustrative example 1: At the boundary

The vehicle is intercepted and continuously held from 09:10 until 09:40. This is exactly 30 minutes and does not cross the threshold.

Illustrative example 2: One minute beyond

A vehicle is intercepted and held from 11:05 to 11:36. The 31-minute hold meets the duration condition, assuming the underlying event qualifies.

Illustrative example 3: Exclude a prior traffic delay

A vehicle waits in traffic from 13:05 to 13:25 and is intercepted and held from 13:25 to 13:52. Total stationary time is 47 minutes, but the qualifying detention on these facts is 27 minutes.

Illustrative example 4: Cross midnight

A hold from 23:48 to 00:21 the next day lasts 33 minutes. Record both dates rather than treating the second time as earlier.

Illustrative example 5: Two clocks differ

The driver records the start at 10:12; a later control-room entry says 10:17. At 10:45 the durations are 33 and 28 minutes. Reconcile the actual start before treating the threshold as met.

Illustrative example 6: Report versus release

The supported detention starts at 15:00, the report is made at 15:37 and release occurs at 16:12. The elapsed time at reporting is 37 minutes and actual detention lasts 72 minutes, including 35 minutes after reporting.

Sixteen practitioner FAQs

1. Who may use EWB-04 under Rule 138D?

The rule refers to the transporter.

2. Is EWB-04 compulsory after thirty minutes?

The provision is permissive and applies after the duration exceeds thirty minutes.

3. Does exactly thirty minutes qualify?

No. The rule says more than thirty minutes.

4. Can a traffic jam count?

An ordinary delay does not show interception and detention.

5. Does a driver’s message establish the time on its own?

Preserve it and corroborate against other trip and event evidence where available.

6. What if the start time is uncertain?

Investigate and preserve the uncertainty; do not fabricate a timestamp.

7. Should a hold crossing midnight be entered as one event?

Track one continuous hold with both dates and the actual duration.

8. Can I add two separate stops to pass the threshold?

Analyse each actual interception and detention; do not aggregate unrelated stops.

9. Does the report authorise the driver to proceed?

No. Verify actual release and applicable movement requirements.

10. Does a report extend the e-way bill?

No. Check e-way bill validity separately.

11. Does EWB-04 replace a response to a detention notice?

No. Follow the procedure and deadline for that notice separately.

12. What if there is no written notice at the outset?

Preserve contemporaneous facts about the hold and add later documents when received.

13. How should multiple consignments be tracked?

Link each shipment and relevant e-way bill to the actual vehicle event.

14. Is the portal submission time the detention start?

No. Keep them as separate timeline entries.

15. What if the vehicle is released shortly after filing?

Retain the release time and reconcile the actual duration.

16. Can the report prove the underlying assessment was wrong?

It records detention information. Evaluate any legal challenge on the separate record.
