Check outstanding returns before submitting REG-16
From 1 November 2026, substituted Rule 20 covers taxpayer-requested cancellation under section 29(1). The applicant generally has 30 days from the event warranting cancellation to submit REG-16; death of a sole proprietor is excepted from that time requirement. The substituted rule starts on 1 November; paragraph 35 of the same notification amends the REG-16 form from 1 December 2026. Use the applicable version for the filing date. Check returns required by the application date for periods ending by the requested effective date, including CMP-08 where applicable. If GSTR-1 or IFF has already been furnished for a period, the corresponding GSTR-3B must also be furnished before application.

Prove the relevant stock date
Use the day immediately before application or the day immediately before the requested effective date, as applicable. Do not assume the dates are interchangeable. Record the two dates, reconcile input quantities, inputs in finished and semi-finished goods, capital goods and related liabilities and payments. Section 29(5) separately governs stock-related liability. Under Rule 20(3), submit applicable remaining returns by their due dates.
Distinguish application, suspension and cancellation
Registration stands suspended upon submission during the proceeding. Under Rule 20(5), the returns in sub-rules (2) and (3) must be furnished within the times specified there and all amounts due must be paid. The electronic route additionally requires either (i) monthly output tax on supplies to registered persons not exceeding ₹2.50 lakh in any month from registration to application, using the applicable GST and compensation cess components declared in GSTR-1 (including GSTR-1A amendments) or IFF, or (ii) where applicable, furnishing GSTR-10 within three days from the due date of the remaining returns under sub-rule (3). REG-38 communicates electronic cancellation with effect from the requested date. The three-day condition is a route to electronic cancellation; Section 45 separately requires the covered Section 39(1) population to furnish a final return within three months of the date of cancellation or the date of the cancellation order, whichever is later.
Track an officer referral
If referred under Rule 20(6), retain the officer receipt date. The rule gives 15 days from the officer’s receipt of the referred application for a REG-19 cancellation order if in order or a REG-03 deficiency notice. Reply in REG-04 within 15 days of receiving the notice. After receipt of the reply, track the officer’s 15-day period for approval in REG-19 or rejection in REG-05. No timely reply can lead to deemed rejection communicated in REG-05A. The rule also provides for deemed approval communicated in REG-19 when the officer takes no action within the specified period from receipt of the referral or reply. Record the final effective date and any obligations that remain. A filing acknowledgement establishes submission; it does not establish cancellation.
Six worked illustrations
All facts and amounts are fictional. Calculations illustrate the stated assumptions, not a predetermined legal outcome.
Illustrative example 1: Application clock
An eligible event occurs on 6 November 2026. Adding 30 days gives 6 December; check applicable counting and filing rules.
Illustrative example 2: GSTR-1 filed early
Seven of eight reviewed periods match GSTR-1 and GSTR-3B. The eighth has GSTR-1 but no GSTR-3B, though the ordinary due date is ahead. One additional GSTR-3B is required on those facts.
Illustrative example 3: Threshold exactly met
All three relevant months show ₹1.80 lakh, ₹2.50 lakh and ₹2.10 lakh qualifying B2B output tax. The maximum meets the stated ₹2.50 lakh ceiling; check the other conditions.
Illustrative example 4: Amendment changes eligibility
An upward GSTR-1A amendment of ₹0.18 lakh revises one month from ₹2.40 lakh to ₹2.58 lakh. That exceeds the ceiling by ₹8,000; a low month does not offset it.
Illustrative example 5: Stock cut-off
If the requested effective date of 1 December determines the snapshot, use 30 November. A register of 240 units less 12 issued that day leaves 228, before physical reconciliation.
Illustrative example 6: Deficiency response
REG-03 is received 10 December 2026. Adding 15 days gives 25 December. Verify applicable counting and portal timing and prepare the response ahead of that checkpoint.
