Gurugram POSH Annual Report: What Should an Employer File When There Were No Complaints?

A year with no complaints is not a reason to skip the POSH annual-report exercise. The committee still needs to report accurately, and the employer must address its separate reporting duties. Zero complaints also says nothing by itself about whether the committee was validly constituted, employees were informed or training occurred.

A year with no complaints is not a reason to skip the POSH annual-report exercise. The committee still needs to report accurately, and the employer must address its separate reporting duties. Zero complaints also says nothing by itself about whether the committee was validly constituted, employees were informed or training occurred.

For Gurugram, the reporting year and current district instructions are particularly important. The district’s displayed instruction concerns calendar year 2025 and required submission by 28 February 2026, from the organisation’s official email address to the District Officer’s official email. That date has already passed as at 18 October 2026. It should not be presented as a newly available filing window or silently relabelled as the deadline for calendar year 2026.

An employer preparing the next cycle should maintain its 2026 records now and check the district’s instruction for that actual reporting year before submission. An employer that missed the 2025 submission should address the omission truthfully, retaining the actual submission date and any departmental correspondence.

Separate the committee report from the employer’s disclosure

Section 21 concerns the committee’s annual report to the employer and District Officer. The prescribed reporting particulars include complaints received and disposed of, cases pending beyond ninety days, awareness activity and the nature of action taken.

Section 22 concerns the employer’s annual-report disclosure of cases filed and disposed of. Where an employer does not prepare an annual report, the statutory communication to the District Officer still needs consideration. A company must also assess the applicable Companies Act reporting requirements separately.

These obligations can use reconciled data, but they are not one interchangeable document. Sending the corporate annual report alone does not necessarily complete the committee’s report and district checklist. Conversely, emailing the committee’s statistics does not automatically establish that the employer’s annual-report disclosure was made correctly.

Assign preparation and approval responsibilities clearly. The committee should own its account of complaints and proceedings. HR and compliance can supply constitution and awareness records; the employer supplies its implementation evidence and corporate disclosures. Avoid asking one administrator to sign for facts that only the committee can verify.

Use the correct Gurugram package

The district provides separate comprehensive checklists for government departments and non-government organisations. Select the correct version and preserve a copy of the document used. A private company should not submit the government-department checklist merely because the two files look similar.

The current non-government checklist covers more than complaint totals. Its sections address policies, workplace notices, employee awareness and assistance, committee constitution and training, compliance with recommendations, reporting and the annual-report particulars. It requests supporting material, including the constitution order and relevant display or reporting extracts.

Prepare an attachment index mapping each answer to evidence. For example, identify the policy reference, attach the constitution order and provide a sample notice with its display location. Record awareness dates and delivery methods accurately. A statement that training was conducted is stronger when the date, content and attendance records support it.

The checklist’s wording must be read carefully. One item asks for committee capacity-building information across 2024 and 2025, while other fields focus on the 2025 calendar year. Do not change every year in the form automatically or supply a financial-year total when the field asks for calendar-year activity.

Use the actual current instructions for the next cycle. The existence of an older notice described as applying every year does not eliminate the need to check whether the district has changed its checklist, address, mode or specific requirements.

Prepare a nil report without concealing other facts

If the committee received no complaints during the reporting period, state zero in the received field after reconciliation. Then assess the other fields independently. A complaint carried forward from an earlier year can remain pending or be disposed of during a year in which no new complaint was received.

For example, assume one complaint remained open on 1 January 2025, none was received during 2025 and that earlier case was disposed of inMarch. The report should not show all complaint fields as zero merely because there were no new complaints. The disposal and any relevant aged-pending position need to reflect the facts and reporting convention used.

Similarly, zero complaints does not mean zero workshops. Record actual awareness programmes, or state that none occurred if that is true. Do not create retrospective attendance sheets to improve the appearance of a nil report. Record a missed activity honestly and plan corrective action separately.

A new office should identify its opening date and period of operation. Avoid certifying compliance for months before it existed. If the committee changed during the year, preserve both constitution periods and identify which body’s records support the report. A current committee can reconcile earlier records, but it should not pretend its members personally conducted earlier proceedings.

Reconcile counts using a controlled case ledger

Maintain a restricted ledger with a stable case reference, receipt date, opening status, disposal date and status at year end. Keep the identifying information and underlying evidence separately controlled. The annual return should disclose the required aggregate information without unnecessarily circulating personal narratives.

A useful reconciliation is:

Item Control question
Opening cases Which earlier complaints were unresolved at the start?
New receipts Which qualifying complaints were received during the year?
Disposals Which cases were concluded during the year?
Closing cases What remained pending at year end?
Over-ninety-day cases Which pending cases meet the prescribed age description?

The relationship between opening cases, receipts, disposals and closing cases helps detect omissions. It does not replace a legal assessment of whether a communication is a complaint, how a transferred case is counted or whether a purported closure was valid.

Do not equate every informal question with a registered complaint or exclude an actual complaint because it arrived through an unexpected channel. The competent committee should assess the record. Where a case moved between bodies or locations, document the treatment so that corporate aggregation does not double count it.

For aged cases, calculate from recorded dates and explain delay where the checklist requests reasons. A case described as closed in an HR tracker may still be pending before the committee. Resolve that discrepancy before signing.

Report awareness and committee changes with evidence

Distinguish in-person sessions, virtual orientation, instructor-led activity and e-learning where the checklist asks. Record dates, covered groups and relevant languages. Do not report a single session as four programmes merely because it used slides, discussion, a video and a quiz.

Consider contract staff and other relevant workplace groups. A training attendance list limited to permanent office employees may not explain how security, cleaning or other deployed workers were reached. Preserve vendor coordination and accessible communication evidence where relevant.

For committee training, retain the programme dates and subjects and identify the members who attended. A general employee awareness session is not automatically the same as committee capacity building. The committee needs the ability to administer a fair process, not merely recognise a policy slogan.

Where membership changed, retain appointment, resignation, replacement and term records. Check that the year-end member table does not list someone who left months earlier. Explain the historical period rather than overwrite it with the current membership and suggest that it applied throughout the year.

assureOffice can help organise related practice working papers and the employer’s financial context. Confidential complaint files need separate restricted handling, and assureoffice.in should not be described as a verified integration for submitting Gurugram’s district return.

Follow the actual sender, recipient and submission mode

For the displayed 2025 reporting-year instruction, Gurugram required the report to be emailed from the concerned organisation or department’s official email address to posh-grg.rev@hry.gov.in. A consultant may prepare and review the package, but sending it only from the consultant’s own mailbox does not meet that stated sender requirement.

Before transmission, check the recipient against the official district page and applicable instruction. The current page identifies the District Officer as the Additional Deputy Commissioner and gives the office at Vikas Sadan near the Mini Secretariat. Do not rely on an old officer’s personal address or a forwarded WhatsApp message when the official instruction specifies a receiving mailbox.

Make the subject and covering message identify the legal entity, Gurugram office, reporting year and attachments. Sign or authenticate the report and checklist as the applicable documents require. Do not claim a particular signature method is mandatory unless the current instruction says so.

Check that the attachment opens and contains the correct year and complete pages. Keep sensitive case material out of a general attachment unless specifically and lawfully required. A report’s delivery is not improved by adding an unnecessary complaint file containing personal evidence.

Retain proof and handle omissions transparently

Save the final signed package, attachment index, sent message with headers, delivery or bounce information and acknowledgement. A screenshot of a draft email is not evidence of submission. Equally, a sent email is not necessarily an acceptance acknowledgement; preserve whatever response the office provides.

If the message bounces or a file is rejected, correct and resend through the specified route promptly. Preserve both attempts and explain the correction. Do not change the first message’s date in the evidence file to make a later successful submission appear timely.

For a missed deadline, identify the reporting year and omission, prepare the accurate outstanding report and seek the District Officer’s current direction on late submission. Do not invent an extension or backdate the report. Penalties require examination under the actual statutory and procedural framework; avoid treating a headline fine as an automatic late-filing invoice in every case.

For 2026, maintain records through 31 December and establish an internal preparation calendar. Then verify the 2026 reporting-year notice, checklist, deadline and route. Supporting evidence can be organised alongside other compliance papers at assureoffice.in, while the actual filing and acknowledgement remain the employer’s responsibility.

Frequently asked questions

1. Is a nil-complaint year exempt from annual reporting?

No. The reporting exercise includes required complaint statistics and other particulars. Prepare the committee report and address the employer’s separate duties. Zero complaints should be a verified figure, not a reason to leave the report unprepared.

2. What reporting year does the currently displayed Gurugram instruction concern?

It expressly concerns calendar year 2025, with submission by 28 February 2026. Those dates should be described as a completed reporting cycle in an October 2026 article. Verify the instruction for 2026 before applying a deadline to that year.

3. Can the previous deadline simply be moved forward one year?

Do not assume that the submission mode, checklist and specific instructions remain unchanged. Monitor the official district route and use the notice applicable to the actual reporting year. An internal planning date is different from a verified district deadline.

4. Is the calendar year the same as the financial year?

No. Calendar year 2025 runs from 1 January to 31 December 2025. A financial-year report may span different dates. Reconcile the information across reports and label each period so that totals are not compared as though they cover identical months.

5. Can all complaint fields be zero if no new complaint arrived?

Not necessarily. Earlier complaints may have been disposed of or remained pending during the year. Assess each field using the case ledger and the reporting period. No new receipts does not establish no case activity.

6. Should pending cases be reported only when they exceed ninety days?

Follow each required field and disclosure. The prescribed annual committee particulars specifically ask for cases pending beyond ninety days, while other reporting obligations may require broader pending information. Maintain the full ledger so the correct figures can be extracted.

7. What if no awareness programme took place?

State the actual position and address the underlying compliance gap separately. Do not invent a session or reuse an earlier year’s attendance as current evidence. A truthful report can be accompanied by a genuine corrective plan where appropriate.

8. Which checklist should a private company use?

Use the non-government organisation checklist applicable to the relevant cycle. Gurugram displays separate government and non-government files. Retain the version used and map its requests to supporting documents rather than assuming the annual statistics alone complete the package.

9. Does a company annual report replace the committee report?

Not automatically. The committee’s section 21 report and the employer’s section 22 disclosure have different functions. Corporate reporting requirements may add another layer. Use reconciled data but confirm that each required recipient and document has been addressed.

10. Can a consultant send the report from a personal mailbox?

For the displayed 2025 instruction, the sender must be the concerned organisation’s or department’s official email address. A consultant can prepare the material, while an authorised organisational sender transmits it through the required route.

11. What recipient was specified for the 2025 cycle?

The official page specifies posh-grg.rev@hry.gov.in. Check the actual current instruction before a later submission. A copied email address in a previous year’s working paper should not override an updated official receiving route.

12. Must the report be sent physically as well?

Do not invent an additional mode. The displayed 2025 instruction states acceptance only through the District Officer’s official email. Follow any current applicable direction for the relevant year and retain proof of the actual submission made.

13. How should a newly opened office report?

Identify its opening date and actual period of operation, then answer the applicable questions truthfully. Preserve committee and awareness records from that period. Do not certify a full year of activity if the office existed for only part of it.

14. Can an out-of-State head office file one undifferentiated report?

Assess the Gurugram office and competent committee’s reporting responsibilities separately. A corporate summary should not conceal the local unit or replace district instructions. Reconcile local reports into the corporate disclosure without duplicate counting.

15. How should committee changes be described?

Preserve the dates and records for each constitution period. Use the correct current members in the relevant table and explain changes where needed. Do not imply that newly appointed members held office throughout the historical reporting year.

16. Should complainant names be attached to prove the counts?

Do not circulate identifying details merely to substantiate aggregate figures. Apply the confidentiality provisions and the actual lawful request. Keep the detailed restricted ledger available for authorised verification while submitting the required report particulars appropriately.

17. Is a sent-email screenshot sufficient evidence?

Keep the actual final attachments and sent message with recipient and date information. Preserve delivery failures and acknowledgements too. A screenshot can supplement those records, but a draft screenshot does not prove that the package was sent.

18. What if the deadline was missed?

Prepare the accurate outstanding package and seek the District Officer’s direction on submission. Record the true date and reason for the omission. Do not backdate or claim an extension that has not been issued.

19. Does filing cure a defective committee?

No. Reporting and valid constitution are separate obligations. Correct membership, term or office-coverage defects through the proper process and preserve the history. A truthful annual submission should not be used as a substitute for that corrective work.

20. What should an employer do now for 2026?

Maintain the complaint ledger, committee records, awareness evidence and implementation records throughout the year. Reconcile them after year end and verify the actual district notice before filing. This makes a nil report evidence-based and a non-nil report easier to prepare accurately.
