A Karnataka business engaging a housekeeping agency should check the workers, workplace and payment evidence before treating the agency’s invoice as a complete compliance file. Outsourcing the employment relationship does not outsource every duty of the establishment. The principal employer has direct welfare responsibilities and, where the OSH contract-labour provisions apply, exposure when the contractor fails to pay wages.
The current starting point is the Occupational Safety, Health and Working Conditions Code, 2020, implemented in November 2025. A checklist based solely on the repealed Contract Labour Act’s historical threshold can misstate current coverage. Karnataka procedures must also be distinguished from the final Central Rules: an ordinary private state-sphere office should not automatically use a central form because it is readily available online.
Identify all parties and deployment locations
Record the client entity, premises occupier, person controlling the establishment, contracting agency and any subcontractor. The party signing the purchase order may differ from the business operating the premises. Determine who is the principal employer under the statutory definition rather than assigning that status to whichever person receives invoices.
List every deployment address, start date, supervisor, shift and activity. Cleaning an office, handling hazardous industrial waste and providing laundry services at a facility have different operational risks. A vendor’s corporate registration proves its existence; it does not establish permission to deploy the specified workforce at every location or perform every task.
Ask whether workers are supplied directly by the agency named in the contract. If another agency recruits or pays them, record the chain. The OSH definition of contractor includes a subcontractor. An undisclosed subcontract should trigger investigation before access cards and payroll evidence become impossible to reconcile. Commercial consent to subcontracting should be documented separately from statutory permission.
Apply the right thresholds
Test establishment registration and contract-labour licensing separately. The OSH establishment definition and registration chapter have their own coverage, including the ten-person provisions relevant to that chapter. The contract-labour Part applies to establishments employing fifty or more contract labour on any day in the preceding twelve months and to manpower-supply contractors meeting its separate fifty-person test.
Do not count only the housekeeping agency in isolation when testing the establishment’s aggregate contract labour. Include other qualifying deployments and overlapping agencies as the statutory test requires. Conversely, do not assume every person employed by a vendor anywhere in India is deployed at your premises. Keep establishment and contractor calculations in different columns.
The contractor’s own coverage may require a licence even where its deployment at a particular small customer is modest. A statement that “only twelve cleaners work here” does not settle the agency’s separate manpower-supply test. Record the basis on which the contractor says a licence is required or not required and examine the evidence behind that statement.
An establishment below a licensing threshold is not thereby exempt from wage-payment, safety or social-security law. The Code’s general protections and the separate social-security schemes require their own tests. A procurement team should never convert “no contractor licence required on these facts” into “no employee compliance evidence required.”
Review the licence and transition documents
Obtain the actual licence, amendments and relevant existing certificates. Check the holder’s legal name, issuing authority, permitted number, validity, work scope and location-related conditions. Where the contractor relies on a multi-state licence, examine its actual scope and the work-order information obligations. A licence issued to a similarly named group entity does not cover the contracting entity merely because the agencies share a brand.
For Karnataka state-sphere procedures, obtain the operative state instrument or written departmental instruction used for registration, renewal or transition. January 2026 draft OSH rules are not, merely by publication for comments, final procedural law. Existing rules and actions may continue under the Code’s savings provisions to the extent permitted; that requires a legal reconciliation, not an assumption that every legacy form or threshold remains unchanged.
Maintain a transition note stating what certificate is relied on, why it continues, any update required and the responsible officer or designated authority. If the portal retains an old Act name, preserve the current departmental instruction authorising its use. Do not invent a new certificate or backdate a document to make a procurement checklist look complete.
A site change, additional workforce or new customer may require an amendment or other information submission. Investigate a licence naming a different worksite instead of accepting a generic assurance that all offices are covered. Record the eventual resolution before approving a materially expanded deployment.
Match attendance, wages and contributions worker by worker
The monthly control should begin with an agreed deployment roster. Reconcile names and employee identifiers to access logs, attendance, leave, overtime and replacements. Access records alone can be incomplete, but an unexplained mismatch is a useful warning. Avoid collecting unnecessary identity documents or circulating unrestricted copies of workers’ personal information.
Next obtain the wage register or appropriate payroll extract, wage slips and bank-payment evidence. Check wage period, category, ordinary hours, overtime, deductions and net amount. An agency invoice shows what the agency charged the customer. It does not prove that a particular cleaner received wages, nor that the correct minimum rate and overtime were paid.
Then reconcile covered workers to EPF and ESI evidence. A consolidated challan proves a payment to the organisation; it does not by itself show that every person on your roster was included at the correct wages. Obtain the relevant contribution detail and payment confirmation, investigate missing identifiers and preserve the explanation for any valid exclusion. Existing membership history can affect PF treatment even for a higher-paid worker.
The EPF Scheme, 2026 adds concrete principal-employer and contractor reporting duties. Paragraph 27 requires declaration of contractors in Form X, the contractor’s employee-level statement in Form XI within ten days of month-end, and the principal employer’s monthly abstract in Form XII within twenty days. It also recognises compliance through the dedicated EPFO portal where the specified information is made available there. The contractor and principal employer are jointly and severally responsible for the scheme contributions and charges. Build these duties into the monthly evidence calendar.
Use the operative social-security scheme for the relevant month, including 2026 replacements and amendments where applicable. Do not carry forward old contribution assumptions merely because a vendor’s spreadsheet uses them. The evidence file should distinguish membership, wage base, ceiling, rate, remittance and employee identification, rather than treating an undifferentiated certificate as proof of all six.
Allocate welfare and safety duties explicitly
Section 53 of the OSH Code places responsibility for the specified welfare facilities for contract labour on the principal employer. The commercial contract should say who arranges drinking water, sanitation, rest facilities, first aid and other applicable amenities, but a reimbursement clause cannot erase the statutory responsibility.
Perform a site induction addressing chemicals, protective equipment, electrical areas, working at height, waste handling and emergency contacts. Housekeeping workers often work before or after ordinary office hours; ensure they can actually access required facilities during those shifts. A locked first-aid room or unusable toilet is not cured by a well-written vendor policy.
Specify incident reporting, immediate medical assistance, document preservation and escalation. Record who notifies the relevant authority, benefit organisation and insurer where required. Do not wait for the contractor’s head office to approve emergency assistance. Allocate investigation and corrective action without requiring workers to waive statutory rights.
The principal employer should also provide a channel for deployed workers to report unpaid wages, unsafe conditions or harassment. Confirm that the agency’s supervisor can resolve ordinary queries and that serious complaints reach a responsible client officer. A shared contact list is useful only if someone owns the response and records the outcome.
Respond to wage default promptly
Under the applicable contract-labour provisions, the contractor is responsible for paying wages and informing the principal employer electronically of the amount paid through the prescribed payment mode. If the contractor defaults or short-pays, the principal employer is liable to pay the wages or unpaid balance and can recover the amount from the contractor as permitted.
Investigate a complaint using attendance, payroll and bank evidence. Do not dismiss it because the agency has issued a compliance certificate. Identify the amount genuinely due, the statutory payment deadline and the immediate remedy. Commercial disputes about the agency’s invoice should be separated from wages already earned by workers.
Keep recovery rights, security deposits and indemnities in the contract, but avoid making those provisions the only response plan. Decide in advance who can authorise payment, obtain verified bank details, prevent double payment and record recovery. A payroll and legal review is preferable to an improvised cash settlement with a supervisor.
Change agencies without losing the evidence trail
Before replacement, freeze the outgoing roster and reconcile the final wage month, overtime, leave, contributions and outstanding complaints. Record workers who leave, continue under the new agency or remain temporarily during handover. Continuous physical presence does not settle employer identity or service-related benefits; preserve the underlying employment facts.
Obtain the outgoing agency’s final payment evidence and a list of unresolved liabilities. The new agency should issue its own appropriate engagement documents and complete required onboarding. Reusing the same workers should not mean creating a new identity number or ignoring earlier benefit membership. Do not certify a clean exit while contributions or wage disputes remain unexplained.
A useful handover pack includes the contract, amendments, site roster, licence basis, attendance, wage proof, contribution records, incident register and pending matters. These are practical record controls; the exact statutory retention requirement must be drawn from the applicable instrument. A practice can coordinate this evidence alongside its financial work in assureOffice, without suggesting that assureOffice issues contractor licences.
A procurement sign-off checklist
Before deployment, confirm the parties, locations, work, coverage counts, government jurisdiction, licence basis, statutory wage classification, social-security enrolment and welfare arrangements. During deployment, reconcile each worker’s attendance, wages and contributions and investigate gaps. At exit, complete the settlement and evidence handover before describing the contract as closed.
Set an exception owner and a realistic resolution date for every missing item. A checklist in which every answer is “vendor responsible” has not examined the principal employer’s obligations. Information at assureoffice.in may support a practice’s broader workflow decisions; the statutory assessment and the government filing route require their own verification.
Frequently asked questions
1. Is the contractor’s invoice enough to show workers were paid?
No. Reconcile attendance, wage calculations and bank-payment evidence for the people deployed. An invoice records the agency’s charge to the customer. It does not establish the individual employee’s wage entitlement, lawful deductions or receipt of the correct net payment.
2. Does every housekeeping arrangement require the same licence?
No. Establishment and contractor coverage, count history, jurisdiction and licence scope matter. Apply the OSH contract-labour test and the operative procedures. Do not use a historical threshold or assume a small deployment settles the contractor’s separate manpower-supply coverage.
3. What if the licence names a different worksite?
Ask for the licence conditions, work-order information and amendment or other authority evidence supporting the actual deployment. Do not accept a verbal assurance as resolution. A broader valid licence may be relevant, but its actual terms must be examined.
4. Can one agency certificate cover an undisclosed subcontractor?
Not automatically. Identify the recruiting, employing and paying entities and review each required permission and obligation. The contractor definition includes subcontractors. A certificate issued by the lead agency cannot replace facts about the workers and the actual subcontracting chain.
5. Who should respond when cleaners report unpaid wages?
The contractor must investigate and pay, and the principal employer should promptly verify the complaint. Where the applicable OSH provisions impose default liability, the principal employer must address the unpaid amount and pursue recovery separately instead of leaving workers in the commercial dispute.
6. Does a contractual indemnity eliminate principal-employer liability?
No. It may support recovery between contracting parties, but statutory duties remain. The client needs a practical response for unpaid wages, welfare and safety. Review the indemnity’s enforceability and financial value without treating it as proof that compliance occurred.
7. Are welfare facilities solely the agency’s responsibility?
The OSH contract-labour provisions place the specified welfare-facility duty on the principal employer. The contract may allocate arrangements and costs, but the establishment should inspect actual availability. Facilities must be usable during the workers’ shifts, including early or late cleaning schedules.
8. Is a PF challan sufficient evidence for every cleaner?
No. Match the relevant employee-level contribution details to the site roster and confirm payment. A consolidated challan can include other workers while omitting yours. Investigate missing names, incorrect wages, duplicate identifiers and any claimed exclusion on an individual basis.
9. Can a worker waive mandatory PF or ESI coverage?
An appointment letter or declaration cannot override mandatory law. Determine scheme coverage and membership using the operative provisions and employment history. Preserve a reasoned exclusion record where lawful, rather than relying on a general worker consent form.
10. Should all contract workers be counted with direct employees?
The answer depends on the particular obligation and definition. Keep separate categories and apply each counting test. For the contract-labour threshold, examine qualifying contract labour and the look-back period; for other obligations, use the relevant employee or worker test.
11. Does ordinary office cleaning raise core-activity concerns?
Housekeeping in the nature of support service is specifically relevant to the OSH definition. Examine what the establishment itself is set up to do. A business selling cleaning services cannot assume the same conclusion as an unrelated consulting office merely because both call the work housekeeping.
12. What if the agency changes every year?
Repeated replacements do not justify losing service or contribution records. Preserve each employment and deployment period and investigate workers who remain at the site. Employer identity, continuity and benefit entitlement require facts beyond the agency name appearing on the current invoice.
13. Can we delay worker wages because an invoice is disputed?
Earned statutory wages should not be treated as security for a procurement dispute. Establish the due amount and applicable payment obligation promptly. Deal with service deficiencies, recoveries and vendor invoices through the contract while protecting the workers’ independent statutory rights.
14. What should the outgoing agency hand over?
Obtain the final roster, attendance, wage calculation, payment proof, contribution details, incident records and unresolved claims. Record which documents remain outstanding and who will obtain them. A no-dues letter is useful only to the extent supported by the underlying facts.
15. Are January 2026 Karnataka draft rules final law?
Publication for objections does not itself make draft rules operative. Identify the final Gazette or valid saved procedure and departmental directions for the duty concerned. Do not implement draft forms as compulsory state filings without establishing their legal status.
16. Can we use Central Rules forms at a private Karnataka office?
First determine the appropriate government and the rule-making power involved. Central forms are not automatically the state-sphere procedure. Obtain the operative Karnataka route or current written transition instruction for the specific registration or licence rather than choosing a convenient form online.
17. What records should be checked before increasing deployment?
Recalculate establishment and contractor coverage, review permitted licence numbers and scope, update the roster and reassess welfare capacity. Confirm that the new workers are properly onboarded for wages and social security. An approved purchase-order increase is not statutory approval by itself.
18. How should personal information be handled?
Collect what is needed to identify workers and verify obligations, restrict access and avoid unnecessary circulation of identity or bank documents. Use identifiers consistently. Compliance review needs sufficient evidence, but it does not justify collecting unrelated sensitive information from every deployed worker.
19. What happens when an agency worker is injured?
Provide immediate assistance, preserve the incident facts and identify the applicable reporting and benefit routes. Notify responsible client and agency officers promptly. ESI, compensation, safety reporting and insurer notification require separate assessment; an insurance certificate does not end the establishment’s responsibilities.
20. Does assureOffice obtain the contractor licence?
No such capability should be assumed. assureOffice may support the surrounding practice and financial workflow. The licence must come through the competent government route, and the business should retain verified permission, worker evidence and a reasoned applicability assessment.
