Madhya Pradesh Professional Tax When an Employee Also Freelances or Has Two Employers

Professional-tax deduction on a Madhya Pradesh payslip does not always finish the employee's enquiry. Section 8(2) of the M.P. Vritti Kar Adhiniyam specifically brings simultaneous employment and employment combined with a trade, profession or calling other than agriculture into the individual registration review. Payroll and the individual should therefore exchange facts before deciding who deducts, who pays directly and how earlier deductions are recognised.

The law supplies a more precise answer than “pay once somewhere.” Section 4 contains a prescribed-certificate route and an express adjustment option. Those mechanisms should be used with evidence. They do not justify an informal instruction to switch professional tax off at one employer or a general credit for tax paid in another state.

Separate three situations at the outset

A sequential job change means one employment ends before another begins. Simultaneous employment means the person works for more than one employer during an overlapping period. Employment plus freelancing involves salary and a separate professional or business activity. These situations may produce similar-looking payslips but require different legal analysis.

Collect employer names and addresses, actual employment dates, work locations, annual salary details and deductions already made. For independent work, record the services, commencement date, turnover or receipts and registration status. A weekend consulting activity cannot be classified just by adding its bank receipts to salary; the non-salary schedule entry and its own criteria must be examined.

Agriculture is expressly distinguished in the relevant provisions. That does not mean every receipt described as farm-related automatically escapes review. Establish what the person actually does. Agricultural cultivation, selling someone else's goods and providing paid technical consulting to farmers are not interchangeable facts.

Read section 8 with section 4

Section 8(2) addresses persons liable under the Act other than ordinary salary earners whose tax is payable by the employer, while expressly including salary earners who also conduct the specified non-agricultural activity or have simultaneous employers. Section 8(3) prescribes application within thirty days of becoming liable. The assessment starts with liability under the Act; it is not a rule that every hobby or every second bank receipt creates the same tax amount.

Section 4(2) covers a salary earner falling under a higher-rate non-salary schedule entry, or someone simultaneously employed by more than one employer. With the prescribed certificate declaring registration under section 8(2) and personal payment, the employer deduction exception can operate. The proviso also permits the person to opt for employer deductions, which stand adjusted towards that person's tax for the year.

Read these provisions together. Registration, a certificate furnished to the employer and the eventual payment working are separate steps. Merely filing a registration application does not prove that a certificate has been issued, tax has been paid or an employer has received the required declaration.

Use the right forms and keep the supporting facts

The rules distinguish Form 1 for an employer's application from Form 3 for a person's application. The corresponding certificates are Forms 2 and 4. Rule 3A allows electronic applications in the notified framework. Use the department's current electronic route, but retain the statutory capacity and form identity in the file rather than relying on a screenshot of a menu.

Rule 9 identifies Forms 5 and 6 for the employee-to-employer certificates. Form 5 addresses the professional or other higher-rate category situation; Form 6 addresses simultaneous employment. Read and complete the relevant form accurately. Do not obtain a blank signature, or use a generic “other employer deducts tax” email where the rules require a certificate.

Form 3 itself asks for the independent activity or, where there are simultaneous employers, the names and addresses of all employers and monthly salary from each. That is a useful guide to the factual pack. Keep the registration certificate, declarations, submission evidence and later changes together. Each employer needs sufficient evidence to support its own deduction decision.

Apply the amended schedule, not an old printed table

The 2018 amendment replaced the schedule. For salary and wage earners, the relevant annual bands include ₹1,500 where annual salary exceeds ₹2,25,000 but does not exceed ₹3,00,000; ₹2,000 above ₹3,00,000 up to ₹4,00,000; and ₹2,500 above ₹4,00,000. The specified monthly collection is ₹125 for the ₹1,500 band, ₹166 for eleven months and ₹174 in the twelfth for the ₹2,000 band, and ₹208 for eleven months and ₹212 in the twelfth for the ₹2,500 band. Use the actual schedule wording at boundary cases.

The salary definition includes regular remuneration and allowances in cash or kind and specified perquisites, while excluding bonus, gratuity and pension. CTC, net salary and professional gross receipts are therefore not interchangeable measures. The amended non-salary entries include turnover-based criteria for registered dealers and suppliers, and other persons supplying goods or services. Match the person's actual category rather than reusing an obsolete profession-standing table or an old optional-income mechanism.

The Act's same-person overlap rule applies the highest applicable scheduled rate where more than one entry covers that person. It does not instruct the individual to add all applicable entry amounts together. Nor does it treat a person's separate company as the same taxpayer simply because the individual owns it.

Work through the adjustment instead of guessing

Suppose an individual has two concurrent employers and each payroll has begun deducting professional tax. The individual should disclose both employments and obtain the section 8 registration review. Decide whether the prescribed direct-payment certificate route or the express employer-deduction option will be used. Create a financial-year statement showing each employer, period, salary, amount deducted and government payment evidence available. A duplicate-looking deduction is an exception to resolve, not permission to suppress the next employer's deduction without documentation.

For an employee who also supplies independent consulting services, begin with separate salary and business-category workings. If the non-salary entry produces the higher rate, the certificate mechanism becomes relevant. If no higher non-salary amount arises, that does not remove the need to consider section 8(2), registration facts and the correct reporting route. Document the conclusion rather than assuming payroll automatically settles the independent activity.

An employer's deduction is not necessarily the same as successful government remittance. Request a period-specific confirmation and, where appropriate, the relevant challan details. Protect other employees' personal data when sharing a combined employer receipt: a certified extract or employer confirmation may be more appropriate than circulating an entire payroll return.

Keep payment and return calendars distinct

Section 12 specifies payment of employer deductions within ten days after the end of the month for which deduction was made. The employer return framework under Rule 11 is quarterly in Form 7, due by the fifteenth of the following month, with an annual-return permission mechanism in specified circumstances. These are different clocks. Waiting until the quarterly return date to make every payment can therefore be wrong.

The individual's registration, payment and return duties require their own calendar. Section 10 and Rule 12 address the return for other registered persons, with Form 9 in the rules. Check the applicable exemption notification and certificate before assuming a return or payment obligation has disappeared. A notification extending a specified exemption does not necessarily exempt every employee or every freelance activity.

At year end, reconcile scheduled personal liability, employer deductions being claimed for adjustment, direct payments and submitted returns. Where the result is an excess, follow the statutory refund or authorised adjustment process; do not manufacture a carry-forward by simply reducing a future employer's payroll. Preserve any departmental order supporting an adjustment.

Give unresolved cases a clear escalation path

Prepare a concise factual note when employers disagree or the category remains uncertain. Attach employment periods, activity description, earnings analysis, certificates, deduction details and the specific question. Ask the competent assessing authority to address the unresolved point. A written question about these facts is more useful than asking vaguely whether “double PT” is allowed.

Within a wider assureOffice practice workflow, an adviser can track the client discussion and ownership of follow-up. The statutory working, employee certificates and government evidence remain distinct records. Do not claim that assureoffice.in automatically exchanges declarations with employers, obtains registration or adjusts government PT balances.

Frequently asked questions

1. Does salary deduction settle professional tax on freelancing?

Not automatically. Section 8(2) expressly includes the specified combination of employment and non-agricultural trade, profession or calling. Review the independent activity's schedule classification and the section 4 certificate or deduction-adjustment route, then reconcile the individual's obligation for the year.

2. What changes when two employers pay salary concurrently?

The simultaneous-employment provisions become relevant. Disclose both employers, earnings and periods, examine individual registration and complete the prescribed certificate where used. Do not treat the situation as a simple sequential job change or assume the larger employer automatically becomes the only deductor.

3. Can an employee ask one employer to stop deduction?

An oral request is inadequate. The employer needs the prescribed certificate and facts satisfying the statutory exception. Keep the registration evidence and certificate on file before changing payroll. A payroll setting is an implementation step after the legal decision has been made.

4. Which form concerns simultaneous employment?

Rule 9 refers to Form 6 for a person simultaneously employed by more than one employer. It should identify the relevant facts accurately. Do not substitute Form 5 merely because both forms concern an employee's declaration to an employer.

5. What is Form 5 used for?

It addresses the higher-rate professional or other non-salary entry situation contemplated by section 4(2). Check that the activity and applicable entry really support the statement. A form signed without a category calculation does not provide a reliable basis for stopping salary deductions.

6. Which individual registration application is relevant?

The rules prescribe Form 3 for persons under section 8(2), with Form 4 as the certificate. Form 1 and Form 2 relate to the employer capacity. Electronic services should still be checked against these distinct legal roles.

7. Must all freelance receipts be added to salary?

Do not combine unlike measures without reading the schedule. Salary bands and business or supply entries can use different criteria. Prepare separate computations, then apply the same-person overlap rule and the statutory adjustment route to reach the appropriate result.

8. Can the individual choose continuing employer deductions?

Section 4(2)'s proviso permits the person to opt for deduction by the employer or employers, with amounts deducted adjusted towards the person's tax for that year. Record the option, actual deductions and annual reconciliation. This is not a general inter-state credit provision.

9. Is an old payslip enough to establish adjustment?

A payslip supports the fact of a payroll deduction but may not prove remittance or its allocation. Obtain a period-wise employer confirmation and available payment references. Resolve inconsistent amounts before treating them as an undisputed adjustment in the individual's working.

10. Is agriculture treated like consulting?

The relevant provisions expressly distinguish agriculture. Identify the actual activity rather than relying on a label. Paid consulting for agricultural clients is not automatically the individual's own agricultural activity, and a separate trading business needs its own schedule review.

11. Are bonus and pension ordinary salary components for MP PT?

The salary-or-wages definition expressly excludes bonus, gratuity and pension. Review genuine components and retain the payroll reconciliation. An item cannot safely be excluded merely by renaming regular salary as bonus in a spreadsheet.

12. Why should an old MP tax table be treated cautiously?

The 2018 amendment substituted the schedule and omitted the former optional-income provisions. Old department compilations can contain historical tables and text. Use the amendment with the principal Act instead of treating an old PDF's upload date as evidence that every printed provision remains current.

13. Is professional tax paid only when the quarterly return is filed?

No. Section 12 specifies employer payment within ten days after month end. The ordinary quarterly Form 7 return has a different deadline. Reconcile monthly challans to the quarterly return so payment timing is not confused with filing frequency.

14. Can the same person pay every applicable entry separately?

The Act provides for the highest applicable rate where that person falls under more than one schedule entry. Calculate the overlapping categories before paying. Distinct legal persons, such as the individual and a separate company, still require their own analyses.

15. Does changing employers erase earlier liability?

No. Keep the dates, salary and earlier deduction evidence for the financial year. A change of employer is a reconciliation event. It does not cancel registration, remove unpaid tax or create an automatic refund of deductions from the earlier employment.

16. What if one employment is in another state?

Add the work locations and each state's territorial rules to the review. Madhya Pradesh's adjustment mechanism does not by itself grant credit for another state's tax. Obtain specific advice where two jurisdictions claim liability instead of assuming an all-India employee account exists.

17. Can excess tax be carried forward informally?

No. Determine whether a refund or authorised adjustment is available and obtain the required supporting order or evidence. A self-created credit in the next year's payroll can leave the later employer short while the earlier government's payment remains unchanged.

18. What should a year-end reconciliation contain?

Show statutory category, annual liability, employer-wise deductions, direct payments, adjustments claimed and the resulting balance. Link every amount to its period and certificate or receipt. Add missing-evidence exceptions rather than silently treating unavailable information as zero.

19. Who should seek clarification if employers disagree?

The individual should coordinate the complete factual statement, with each employer supporting its own records and decision. Address the competent assessing authority with a specific unresolved issue. Employers should not exchange assumptions while each waits for the other to take responsibility.

20. How can assureOffice be described accurately here?

As part of the adviser's broader client administration and financial workflow. The MP registration, prescribed certificates, deductions and government payments need independent verification. Do not promise automated multiple-employer PT relief or direct government filing through assureOffice without verified product support.
