A business that sells outsourced products under its own brand should examine its plastic-packaging responsibility even when it owns no factory. An importer should do the same when the imported article is a cosmetic, appliance or food product rather than a roll of plastic film. The packaging introduced with the goods is part of the review.
Responsibility follows the actual supply chain and the definitions under the Plastic Waste Management Rules, not merely the description on a purchase invoice. One transaction can involve a packaging producer, a contract manufacturer, an importer and a brand owner. Each entity's registration and data must be considered, while the permitted target adjustments prevent the same quantity being allocated incorrectly.
This article reflects the framework reviewed on 18 October 2026, including the 2024 role and MSME changes, the March 2026 amendment, the Common EPR Portal transition and the August 2026 registration and annual-return notices.
Identify every role the business performs
Start with a flow of goods and packaging: who manufactures the packaging, who packs the product, who imports it, whose brand is used and who introduces the packaged goods into the Indian market. Identify the legal entity at each step and attach its registration evidence.
A producer includes a person manufacturing plastic packaging or intermediate material used to make it. The amended definition also includes contract manufacture of products using plastic packaging and similar arrangements for brand owners. It is therefore unsafe to say that every outsourced manufacturer has no producer role simply because the customer owns the brand.
A brand owner is identified by the applicable brand-owner definition and the goods sold under its brand label. A private-label seller should review its brand and supply arrangements even when all manufacture and packing are outsourced. Where a label's registration status is uncertain, obtain a specific assessment rather than treating a pending or unregistered label as a self-declared exemption.
An importer includes a person importing for commercial use plastic packaging, a commodity with plastic packaging, carry bags, plastic sheets or similar material, plastic raw material and relevant intermediate materials. Importing packaged finished goods can therefore create importer responsibilities without importing empty packaging separately.
The Rules also distinguish manufacturers of plastic raw material, raw-material sellers and plastic waste processors. A retail reseller of another company's finished branded goods should not call itself a raw-material “seller” merely because both involve sales. Use the legal role definitions rather than ordinary commercial vocabulary.
Outsourcing does not erase the brand-owner review
Consider a company that commissions shampoo under its brand. One supplier makes the bottles; another contract manufacturer fills and packs them; a distributor sends the goods to retail stores. The brand-owning company's role cannot be answered by showing that the filling factory bought the bottles.
Obtain the packaging producer's and contract manufacturer's role and registration details, the agreement, packaging quantities, customer allocation and evidence of the brand owner's own registration or applicable treatment. Specify who provides transaction information and how the quantity is reflected in the relevant accounts.
A contract may allocate the cost of compliance or require one party to supply records. It cannot remove a statutory responsibility merely by stating “EPR included in price.” Equally, do not assign the same quantity to several parties without applying the permitted reporting and target adjustments. The objective is an accurate chain, not repeated credit purchases for an unexplained quantity.
When buying finished goods under a supplier's existing brand, distinguish ordinary resale from rebranding or repacking. Adding the business's own branded packaging or importing the goods can change the analysis even if the underlying product is unchanged.
Build a packaging specification for each product
List primary packaging around the product, secondary packaging grouping units and transport packaging. Include plastic bottles, caps, pouches, liners, shrink film, stretch film, plastic cushioning and other relevant packaging. Do not stop at the piece visible on the retail shelf.
For each component, record material, structure, weight per unit, units per product, packaging category, supplier and the version date of the specification. Obtain a signed supplier specification and use representative weighing or technical verification where necessary. A packaging cost of ₹8 does not tell you its regulated weight.
The main categories to screen are:
| Category | Broad description |
|---|---|
| I | Rigid plastic packaging |
| II | Flexible plastic packaging, including eligible plastic-only single or multilayer structures, sheets, bags and pouches |
| III | Multilayer packaging combining plastic with a non-plastic material |
| IV | The specified packaging, bags and commodities made from compostable plastic |
| V | The specified packaging, bags and commodities made from biodegradable plastic |
Older summaries listing only four categories omit the later biodegradable category. Nor are “compostable” and “biodegradable” interchangeable marketing descriptions. Obtain the relevant material, standard and CPCB certification evidence where required; changing the label on a pouch does not establish a different legal category.
For Category III, distinguish two weight bases. The EPR packaging-weight treatment covers the complete multilayer packaging under the applicable clarification. The March 2026 recycled-content target, however, is limited to the plastic-layer weight. Keep both measurements so that one figure is not incorrectly used for every obligation.
Assess MSME treatment separately for each role
Udyam registration does not create one blanket exemption from all plastic EPR requirements. First verify the entity's current micro, small or medium classification, the period concerned and the role being assessed. “MSME” includes medium enterprises, while several relevant provisions refer specifically to micro and small enterprises.
The amended obligated-entity provision excludes micro and small brand owners from the ordinary brand-owner EPR obligation. That does not establish an importer exemption for the same entity. A small company that imports packaged goods must examine its importer role separately.
Micro and small producers have a distinct mechanism. They must register and declare the categories manufactured. The supplier manufacturer or importer of plastic raw material fulfils their EPR through the prescribed mechanism, subject to transaction authentication and the specified exclusions for supplies linked to non-micro/small brand owners and producers. The recycled-content target remains with the micro or small producer under the relevant proviso.
Keep registration separate from target fulfilment. The 27 August 2026 public notice expressly lists producers including micro and small enterprises and addresses the registration of covered participants through the Common EPR Portal. Its transaction-reporting exception refers to micro/small brand-owner and PWP-related transactions as applicable. Do not read that exception as permission for every small business in every role to remain unregistered.
For a micro or small brand-owner-only case, document the precise target exclusion and resolve the applicable registration/portal route under the current instructions. For an entity with importer, producer or raw-material activities as well, document those separately. A one-line conclusion saying “Udyam, so EPR not applicable” is inadequate.
Determine the authority through actual operations
Registration is made through the centralised system, currently accessed through the Common EPR Portal. A shared portal does not mean that every application is decided by the same authority.
The PIBO framework differentiates operations in one or two states/UTs from operations in more than two: the former ordinarily involve the concerned SPCB/PCC, while the latter involve CPCB. Review the current role-specific routing and instructions when applying. Do not count only the registered office or assume that one GST registration proves operation in one state.
Prepare a state-wise list of the covered packaging or packaged-product sales and activities. An own-brand seller shipping into several states should review that footprint even if it has one warehouse. Update the registration profile when the actual scope changes instead of retaining an old jurisdiction selection because it was accepted previously.
For existing plastic registrations, operational use of the legacy portal ended on 28 June 2026. Link and reconcile the migrated record on the Common EPR Portal using the required matching company and authorised-person identifiers. Creating a new login does not itself issue a new statutory registration or complete an old obligation.
Prepare quantity records before calculating targets
Build a financial-year dataset by role and packaging category. Reconcile packaging purchased, imported, used, sold, exported where relevant, held in stock, rejected and transferred through the supply chain. Keep pre-consumer waste separate from post-consumer packaging obligations and preserve the records needed for lawful adjustments.
For imports, obtain supplier packaging bills of material and reconcile them with bills of entry, shipment quantities and product units. Product net weight, gross shipment weight and plastic-packaging weight are different figures. Container pallets, wrapping and protective packaging should be reviewed rather than ignored because they are removed at the warehouse.
For own-brand domestic goods, combine product sales with packaging specifications and changes during the year. If a supplier reduces bottle weight midyear, retain the effective date and quantities for each specification. Applying the latest lighter weight to all historical sales understates the earlier packaging introduced.
Apply the target formula for the actual role and year, including the relevant historical data, deductions and adjustments. Do not use turnover, GST output tax or recycling expenditure as a substitute for the statutory quantity calculation. An adviser should be able to trace a reported tonne back to a supported transaction and packaging specification.
Separate recycling, recycled content and reuse
EPR fulfilment is not one undifferentiated purchase of “recycling credit.” Check the overall obligation, category-specific minimum recycling, permitted end-of-life treatment, recycled-content requirements and applicable reuse requirements. Each has its own legal basis and supporting evidence.
For FY 2026–27, the March 2026 recycled-content tables specify 40% for Category I, 10% for Category II and 5% for Category III. Apply the proper role-specific denominator and conditions. An exemption based on a statutory prohibition on recycled content requires the actual relevant law, regulation, rule or mandatory standard to be submitted with the return; an unsupported statement that the customer prefers virgin plastic is insufficient.
Importers face an especially important distinction: recycled plastic already used in imported material is not counted toward their specified recycled-content obligation. The amended provision requires the quantitative obligation to be fulfilled through the prescribed equivalent-certificate mechanism involving excess recycled-content use. Do not treat a foreign supplier's “30% recycled” certificate as automatic Indian compliance.
The 2026 amendment also provides limited carry-forward arrangements for specified FY 2025–26 food-contact recycled-content shortfalls and Category I reuse shortfalls. These are conditioned reliefs with annual catch-up requirements, not a general postponement of all EPR. Keep any carried-forward quantity separate from the current year's target.
Reconcile certificates with the return
Verify the processor's registration, permitted role and the certificate's category, quantity, reference, financial-year treatment and transfer/utilisation status. Record the portal transaction, not only the processor's invoice. Payment demonstrates a commercial transaction; the official certificate record establishes the credit being relied on.
Do not use one certificate twice or assume an excess in one category can satisfy another without the applicable legal mechanism. Keep a register linking each utilised certificate to the relevant obligation. Resolve differences between supplier and recipient declarations instead of choosing whichever figure produces the lower target.
The 2024 amendment provides that differences in the reported certificate figures are resolved using the lower figure for fulfilment, subject to verification. This makes counterparty reconciliation a practical necessity. An agreement with a waste collector who does no registered processing is not, on its own, an EPR fulfilment certificate.
File under the current annual-return timeline
The ordinary framework must be read with year-specific extensions. For FY 2025–26, the signed 28 August 2026 memorandum extends registered plastic waste processors' annual-return deadline to 31 October 2026 and PIBOs' deadline to 31 December 2026. These are different dates for different roles.
A filing extension does not dispense with environmentally sound management, registration or accurate certificate and transaction records. Do not use a battery or e-waste extension for plastic packaging. Retain the memorandum, submission copy and acknowledgement with the reconciled working papers.
The Common EPR Portal is the current operational route. Compare migrated data with the legacy records and raise precise discrepancies through the official process. A pending helpdesk ticket does not, by itself, create additional filing relief.
Make supplier information a procurement requirement
Before launching a product, obtain packaging specifications, category and weight evidence, supplier registration details, role allocation, recycled-content evidence and the required sales or import information. Put change-notification and annual reconciliation duties into the supply agreement.
An assureOffice adviser can use this information to organise the client's product and supplier review alongside business records. Do not represent an accounting entry or vendor payment as automatic EPR target fulfilment.
For a practice using assureoffice.in, the useful output is a responsibility note identifying the legal entity, roles, packaging categories, supporting data and unresolved decisions. Specialist calculations, portal filing and regulatory approval still require the appropriate process and expertise.
Frequently asked questions
1. Does outsourcing manufacture transfer my brand-owner responsibility?
No automatic transfer occurs. Assess the brand owner's role and the producer role of the packaging or contract manufacturer, then apply the permitted transaction and target adjustments. A contract can allocate costs and records but cannot erase statutory duties.
2. Do imported products count if the business does not import empty packaging?
Yes, the importer definition includes commodities imported for commercial use with plastic packaging. Identify and quantify the packaging accompanying the finished goods rather than treating the product's invoice description as the complete EPR analysis.
3. Can an importer rely on the foreign supplier's recycling arrangement?
Not as a substitute for its own applicable Indian obligations. Obtain useful supplier evidence, but verify registration, targets, recognised certificates and reporting under the Indian framework. A foreign recycling promise does not itself constitute portal fulfilment.
4. Does Udyam registration automatically exempt every EPR role?
No. Identify micro, small or medium status and examine each role separately. A micro/small brand-owner target exclusion does not automatically extend to importer activities or remove the separate registration and declaration duties of micro/small producers.
5. Are medium enterprises covered by the micro/small brand-owner exclusion?
No. The relevant wording specifies micro and small enterprises. Do not use the broader abbreviation MSME to include medium businesses in an exclusion whose terms do not cover them.
6. Must a micro or small packaging producer register?
Yes, the amended registration provision expressly includes them. Their EPR fulfilment mechanism involves the raw-material supplier under specified conditions, while the producer retains relevant declarations and recycled-content responsibility. Keep the transaction evidence needed for that mechanism.
7. Must transport and secondary packaging be considered?
Yes. Review all relevant plastic packaging introduced through the supply chain, including grouping and shipping materials. Excluding every item removed before the retail shelf can omit substantial quantities of wrapping, liners and protective packaging.
8. Is every multilayer pouch Category III?
No. A multilayer structure made only from different plastics is different from one combining plastic and a non-plastic material. Obtain the actual layer specification and category assessment rather than classifying from the pouch's appearance.
9. Is Category III measured only by its plastic content?
Different obligations use different bases. The applicable EPR packaging-weight treatment covers the complete multilayer packaging, while the 2026 recycled-content target is limited to the weight of plastic layers. Retain both figures and apply each correctly.
10. Are compostable and biodegradable plastics outside EPR?
Do not assume so. The framework includes specific categories and obligations for these materials and relevant commodities. Verify the material, certification and applicable route; a supplier's environmental marketing claim does not establish exemption.
11. How should a business that is both importer and brand owner report?
Identify both roles and the same-entity transactions, then use the current registration and adjustment mechanism so quantities are neither omitted nor duplicated. Do not assume one role cancels the other or purchase credits twice without a supported calculation.
12. Does selling into three states matter if we have one office?
It can. The PIBO jurisdiction framework considers actual operations, not only the registered-office address. Prepare the state-wise sales and activity footprint and verify the current application routing before selecting the authority.
13. Does the Common Portal mean CPCB decides every registration?
No. A centralised access and filing system can still route matters to the relevant SPCB/PCC or CPCB. Verify the applicable role and geographic scope rather than equating the website owner with the deciding authority in every case.
14. Can purchase value be used to estimate packaging quantity?
It is not a reliable substitute for supported weight data. Obtain specifications, quantities and verified measurements. Price changes, material changes and different component weights can make a monetary estimate materially misleading.
15. Does a recycler's invoice prove EPR fulfilment?
No. Verify the registered processor and the actual eligible certificate, transfer and utilisation records. Keep the invoice as commercial evidence alongside the portal evidence, and reconcile the category and quantity claimed in the return.
16. Can imported recycled packaging satisfy the importer's recycled-content target directly?
The March 2026 provision says recycled plastic in imported material does not count toward that obligation. The importer must use the prescribed quantitative certificate mechanism. A foreign recycled-content declaration therefore does not automatically discharge the Indian requirement.
17. Is food-contact packaging automatically exempt from recycled-content targets?
No blanket exemption follows from food contact. Establish a relevant statutory prohibition and provide the prescribed evidence where claiming exemption. The limited FY 2025–26 food-contact carry-forward relief also has specific conditions and catch-up requirements.
18. What is the FY 2025–26 annual-return deadline for PIBOs?
The verified 28 August 2026 memorandum extends it to 31 December 2026. The processor deadline is 31 October 2026. Check for any subsequent applicable order before filing and retain the actual notice, rather than relying on another waste stream's deadline.
19. Does registration alone discharge the recycling obligation?
No. Registration, accurate data, target assessment, eligible fulfilment, required recycled-content or reuse duties and returns are distinct tasks. Maintain evidence for each obligation applicable to the business's roles and packaging categories.
20. What should be completed before a new own-brand product launches?
Identify all roles and registrations, classify and weigh its packaging, obtain supplier evidence, assess current obligations and establish the reporting process. Resolve material gaps before introducing the packaging rather than waiting until the annual return exposes missing data.
