Payroll should use a documented location analysis for a remote employee, rather than the location of its own bank account or payroll team. Actual work location, assigned office, residence, duration and changes during the tax period can all matter. The answer must come from the applicable state or local law; there is no single all-India professional-tax location rule.
Karnataka's official employer guidance expressly says that tax follows the state where employees work irrespective of where salary is disbursed. Kerala's village-panchayat law also includes residence-related tests and half-yearly local-body overlap provisions. Maharashtra has its own territorial definitions and employer duties. Applying one state's guidance everywhere can therefore create both missed registrations and unsupported deductions.
Capture four different location facts
Record the employee's actual working address, assigned branch, residential address and the place responsible for salary disbursement. Add the employing legal entity and any establishment in the work state. These facts can point to different places and should not be compressed into one HR field called “location.”
For a permanent remote arrangement, obtain the approved work-from-home address and effective date. For temporary travel, record where work was actually performed, the dates and whether the assigned employment arrangement changed. For hybrid work, retain the recurring office pattern and any extended remote period. A short visit and a permanent relocation should not receive the same unsupported default.
The evidence can be modest: an employee declaration, manager approval, transfer or remote-work letter, relevant attendance or office records and a dated change log. Collect what is needed to establish the facts; avoid gathering intrusive personal information that adds nothing to the tax decision. The purpose is to support jurisdiction and period, not to monitor every movement.
Karnataka: work location is not the salary bank location
The Karnataka employer FAQ addresses a company registered in Punjab with a Bengaluru branch and employees whose salaries are paid from head office. Its answer directs professional tax to the state where the employees work, regardless of salary disbursement. This is useful official guidance for separating operational work location from payroll processing.
For an employee working from Karnataka for an employer headquartered elsewhere, a Karnataka employer-registration enquiry should therefore be made. Do not assume that no duty exists because head office is in Delhi or another jurisdiction. At the same time, the FAQ's branch example does not answer every possible remote-home or travelling-employee fact pattern. Identify the actual employment and local presence and seek a specific departmental answer where the registration nexus is uncertain.
Once Karnataka applies, review its own salary schedule, exemption conditions and employer payment and statement requirements. Do not deduct a rate selected from the head-office state's payroll table. The place where an accountant logs in or the bank through which the salary is paid is an administrative fact, not a substitute for the legal analysis.
Maharashtra: identify employment in the state
Maharashtra's Act addresses persons engaged in a profession, trade, calling or employment in Maharashtra and defines the employer responsible for salary disbursement broadly. Those provisions need to be read with the actual working and employment arrangement. The location of the company's registered office alone is not a complete remote-worker answer.
Consider an employee assigned to a Mumbai office who permanently moves to Karnataka with the employer's approval. Payroll should record when actual work moved, whether the assignment and employing arrangement changed, and which state obligations now arise. Continuing Maharashtra deduction indefinitely simply because the HR cost centre remains Mumbai is not a reasoned territorial decision. Equally, switching it off merely on a new postal address can be premature if the underlying facts are unclear.
Maharashtra employer registration and an entity's own enrolment remain separate. A decision about one remote employee does not automatically determine the company's PTEC position or cancel a PTRC covering other staff. Preserve the employee-level location analysis and review the employer account separately.
Kerala: the local body and half year matter
Kerala's village-panchayat framework is materially different from a state-only location lookup. Section 204 of the Panchayat Raj Act addresses persons carrying on the specified activity or holding an appointment within a panchayat for at least sixty days in aggregate in a half year. It also addresses persons working outside the panchayat who reside in it for at least sixty days in aggregate, as well as the specified investment-income case.
Residence therefore cannot simply be ignored in a Kerala village-panchayat review. Identify the actual local authority, relevant half year, work location and qualifying days. A municipal or corporation address requires the relevant municipal framework; do not label every Kerala place a village panchayat or automatically apply its section number to a municipality.
Section 204 also provides bounded relief where profession tax for the same half year has been paid to another Kerala local authority and the person's place of activity or residence changes. It limits the further amount in the specified circumstances to the difference. The residence/workplace overlap provision likewise addresses the higher levy and apportionment. These are Kerala intra-state provisions. They do not establish a general credit for tax paid in Maharashtra or Karnataka.
Use a comparison record instead of a universal shortcut
For Karnataka, the key official guidance separates working state from salary disbursement. For Maharashtra, establish the statutory in-state employment facts and employer responsibilities. For a Kerala village panchayat, include residence, work, half-year duration and local-body overlap. Put these questions in separate jurisdiction columns rather than forcing every case into an employee's permanent-address field.
An employee whose parents live in Kerala but who normally works and resides in Bengaluru should not be allocated to a Kerala local body solely because that address appears on an old identity document. A person actually residing and working remotely in a Kerala panchayat for a qualifying period raises a different enquiry. Likewise, maintaining an assigned office address in a state does not conclusively answer actual relocation.
Do not infer professional-tax imposition in Delhi, Haryana or Uttar Pradesh merely because an employer or employee is located there. The correct enquiry is whether an applicable enactment imposes the levy on the facts. A non-PT head office does not, however, automatically eliminate duties in another state where staff work.
Build a location-change decision process
Require employees to notify approved work-location changes before the relevant payroll cut-off where practical. The declaration should state old and new work address, actual move date, temporary or permanent intention, assigned office and any other employer. Ask separately about earlier PT deductions and the period they cover.
Payroll should record the jurisdictions considered, territorial provisions, salary period, exemption evidence, registration question and conclusion. Obtain approval from a responsible employer representative. If the result is uncertain, prepare a factual enquiry for the relevant department or local authority and keep the issue open with an owner and response date.
Internal notification cut-offs are recommended controls, not statutory permission to postpone a liability. If an employee reports a move late, identify the affected periods and correction route rather than pretending the change took effect only when the HR ticket was closed. Preserve the original and corrected payroll workings and explain the deduction consequence to the employee.
Manage two apparent claims without inventing credit
Where two states or local authorities appear to claim the same person, collect their actual basis before adjusting. Identify the legal person, period, work days, residence, earnings and deduction or payment already made. An annual constitutional ceiling should not be converted into an informal all-India payroll credit system without the applicable statutory route.
For Kerala local bodies, examine the express same-half-year relief and obtain the earlier official receipt or certificate. For inter-state situations, seek the specific lawful treatment, which may involve clarification, rectification or refund rather than unilateral set-off. Do not suppress a current employer's deduction merely because an old payslip shows an amount paid somewhere else.
Preserve notices and response deadlines separately from the ongoing payroll decision. If a formal demand is wrong, use the available statutory challenge or correction process. A support ticket or employee email does not automatically suspend payment or appeal requirements.
Keep the decision usable for the next payroll
Maintain a location history for each affected employee and review it after transfers, extended remote work or return to office. Link the approved tax treatment to the employer account used and the government payment and submission evidence. Do not let the record consist only of a payroll override with no explanation.
assureOffice may form part of the adviser's wider client and financial administration. The remote-location declaration and legal conclusion require separate verified evidence. Do not claim that assureoffice.in detects employee location, selects an all-India PT rule or automatically files registrations for remote hires.
Frequently asked questions
1. Does the payroll bank account's state decide PT?
No universal rule makes the bank account decisive. Karnataka's official employer guidance expressly distinguishes the working state from salary disbursement. Record the other relevant facts and apply the actual jurisdiction's law instead of using the bank branch as a proxy for employment location.
2. Can a Delhi-headquartered employer have a Karnataka enquiry?
Yes. An employee working in Karnataka can raise a local employer-registration and deduction question even when head office is elsewhere. Establish the actual work and employment facts. Do not infer either universal liability or universal exemption from the registered-office address alone.
3. Does Karnataka's FAQ answer every remote-home case?
Its express example concerns an out-of-state head office and a Bengaluru branch. The work-location principle is useful, but unusual home-office or travelling arrangements still require their own factual and registration-nexus analysis. Seek a specific official clarification where that issue remains unresolved.
4. Should residence always override the assigned office?
No. Residence, actual work and assignment can have different significance under different laws. Kerala's village-panchayat framework expressly includes residence-related tests. Other jurisdictions require their own analysis. Keep the facts separate rather than assigning a universal priority to one address.
5. Is an identity card's permanent address enough?
Usually it is only one item of evidence. It may be outdated or different from actual residence and work. Obtain a dated declaration and relevant approval or transfer documents. The tax decision should follow the facts for the relevant period, not merely the oldest address on file.
6. Is temporary work from a parent's home a relocation?
Not automatically. Record the actual dates, duration, work performed and whether the employment arrangement changed. Apply the applicable territorial and period tests. A brief visit and an approved permanent remote arrangement should not be treated identically without analysis.
7. What period matters in a Kerala panchayat review?
The statutory framework is half-yearly and includes sixty-day aggregate tests for the specified work or residence situations. Identify the actual local body and relevant half year. Municipal and corporation areas require their own applicable provisions rather than automatic use of the village-panchayat section.
8. Can Kerala tax follow residence even where work is elsewhere?
Section 204 includes persons holding the specified activity or appointment outside the panchayat while residing within it for the qualifying aggregate period. Apply its conditions and intra-state overlap rules. Do not omit residence simply because the employer has no office in that panchayat.
9. Does Kerala local-body relief permit inter-state credit?
No such general conclusion follows. The section addresses specified payments and overlap among authorities within Kerala for the same half year. A Maharashtra or Karnataka receipt needs a separate inter-state analysis; it cannot automatically be entered as Kerala local-body credit.
10. Should a Mumbai cost centre keep Maharashtra deduction forever?
No. Review actual work and employment changes when a person relocates. A cost centre is an internal accounting field. It should implement the approved legal conclusion, not replace the territorial enquiry or override evidence of a permanent move.
11. Does one remote hire automatically cancel an old PTRC?
No. Employer certificates may cover other employees and locations. Review certificate coverage separately from the individual worker's treatment. A transfer can require a new state enquiry while leaving the original employer registration active for continuing staff.
12. What should a location-change declaration contain?
Record old and new actual work addresses, move date, residence, assigned office, temporary or permanent status and other employment. Add earlier deduction details where relevant. Keep the employee's statement, manager approval and payroll decision together with the applicable period.
13. What if the employee reports the move late?
Reconstruct the actual effective date and affected salary periods. Determine the permitted correction and payment route and explain the result to the employee. An internal notification deadline does not necessarily postpone statutory liability until the date HR receives the form.
14. Can earlier payslips justify stopping current deduction?
Not by themselves. They indicate a deduction but may not establish remittance, correct jurisdiction or a lawful adjustment. Obtain period and account evidence and identify the applicable relief provision. Do not use an unexplained payroll override as a substitute for that analysis.
15. What if two states appear to tax the employee?
Prepare one factual chronology and identify each state's actual claim and period. Seek the legally available clarification, correction or refund route. There is no assumed all-India PT credit account, and unilateral set-off can create a shortfall in the current employer's account.
16. Is a constitutional annual ceiling enough to claim credit?
It should not be treated as a self-executing payroll adjustment instruction for any two jurisdictions. Determine the applicable statutory mechanism and obtain advice on the facts. Preserve payment evidence and any authority decision supporting the treatment adopted.
17. Does a non-PT head office mean no PT anywhere?
No. A head-office location and a worker's actual work jurisdiction can differ. Examine the law applicable to the working state or local body. Conversely, do not impose PT in a jurisdiction merely by analogy where its applicable law does not impose the levy.
18. Who should approve the final location decision?
The employer should designate a responsible reviewer with payroll and legal input as needed. HR supplies the facts, payroll applies the approved treatment and the adviser supports the law analysis. Keep unresolved questions assigned rather than allowing each team to assume another has decided.
19. What evidence should be retained after the decision?
Keep declarations, approvals, location chronology, legal reasoning, registrations, employee workings and government payment and submission evidence. Add official clarifications and notices where relevant. The next accountant should be able to understand why deduction changed for a particular period.
20. Can assureOffice select the state automatically?
No such functionality is assumed. assureOffice may be relevant to wider practice and financial administration, but actual location facts and jurisdiction-specific legal decisions need a verified process. Do not describe a single automatic all-India professional-tax rule as an established product capability.
