An office does not acquire a reliable labour-law classification simply because its lease describes it as an office. A room used for customer work, a connected store and a repair bench can raise different questions. Start with what people actually do, how the areas function together and whether any manufacturing process takes place.
Uttarakhand's Shops framework can include connected offices and storage. A workshop, however, requires a separate assessment of its processes and the factory provisions under the Occupational Safety, Health and Working Conditions Code, 2020. Calling the activity “light processing” does not settle that assessment.
This guide is reviewed for 18 October 2026. It distinguishes classification from the workforce threshold, the current State registration process and the central Code transition. Its examples illustrate how to prepare a defensible factual file; they do not declare every mixed premises to be a shop or factory.
Prepare an activity map before choosing a category
List each room, floor, yard and connected location. For each area, record its size, access, equipment, work undertaken, staff and relationship to the business. Explain whether customers enter, whether stock is sold or dispatched and whether goods are altered, repaired or otherwise processed.
A practical activity map can use the following structure:
| Area | Questions to answer | Useful evidence |
|---|---|---|
| Customer office | What services are delivered and by whom? | Engagement records, work descriptions and seating plan |
| Store room | What is stored and for which operation? | Stock records, photographs and dispatch trail |
| Repair or processing area | What happens to the article before and after work? | Process note, job cards and equipment list |
| Packing or dispatch space | Is this storage, sale fulfilment or a processing step? | Workflow, material records and staff deployment |
| Separate building | Is it functionally connected or independently operated? | Agreements, control arrangements and location map |
Do not merely repeat the business's objects clause. A company authorised to manufacture may operate only an administrative office at one address. Conversely, a business describing itself as a consultancy may run a substantial product assembly operation behind the reception area.
Connected storage can fall within the Shops definition
The Uttarakhand definition of shop is broader than a retail counter. It includes premises carrying on trade or business or providing customer services, and connected offices, stores, godowns, sale depots and warehouses, including locations elsewhere.
Accordingly, keeping spare materials or customer files does not automatically turn a consulting office into a factory. Ask why the storage exists, what goods are held and whether work on them is undertaken there. The presence of racks, delivery cartons or a stock register is evidence of activity, not a complete legal conclusion.
The statutory establishment definition also covers specified business-related and ancillary activities, subject to its exclusions. An attached shop's relationship to a factory and the benefits provided to its personnel can matter. Do not convert that limited wording into a rule that every office anywhere in a manufacturing company is excluded from the Shops Act.
Record both physical and functional connections. Separate entrances can support a description of the layout, but they do not by themselves prove independent establishments. Common management, shared staff and an integrated production and dispatch flow may point in another direction.
A workshop requires a process assessment
Describe the work in ordinary operational language. Identify the incoming article, the steps performed, the tools used and the outgoing article. Include cleaning, repair, finishing and packing where they occur rather than describing only the final sale.
For example, “computer support” may mean remote advice and software installation. It may instead involve opening customers' machines, replacing parts, cleaning components and testing repaired products. The name covers different factual operations. A classification note should identify which actually happens.
Similarly, a retail business might keep sealed products ready for collection, or it might break bulk material into new packages and apply processing before sale. Those facts require examination rather than an assumption that everything behind a sales counter is merely storage.
Do not decide that an activity cannot be manufacturing because it is small, occasional, manual or described as service work. Ask the relevant authority to assess the process where the boundary remains uncertain.
Use the OSH Code rather than an obsolete threshold shortcut
The OSH Code became effective on 21 November 2025. Its factory definition generally uses twenty workers with power and forty without, with a preceding-twelve-month test and a proviso preserving different pre-existing State thresholds until legislative amendment. Registration coverage has a separate ten-worker rule; being below the factory threshold is not a complete Code exemption.
The manufacturing definition includes activities such as repair, finishing and packing. Merely installing computers without manufacturing does not make premises a factory. Distinguish electricity used for ordinary office functions from power aiding the relevant process.
For a Uttarakhand site, identify the applicable State position, any notified extension and the correct worker count before reaching a conclusion. Do not present the general Code figures as a universal answer for every workshop or historical period.
The practical analysis should therefore run through three questions: what process is carried on, what premises and people belong to the assessed unit, and which provisions apply to those facts? These questions are related, but one cannot replace the others.
Identify the premises and workforce being assessed
A factory analysis concerns premises and their precincts, not simply the room containing a machine. Give the authority the full site plan and staff deployment rather than drawing an artificial line around a bench to obtain a lower count.
Identify workers assigned to office administration, customer service, storage, repair, packing and delivery. Explain contractors, part-time arrangements, shared staff and personnel moving between areas. Use the applicable definitions rather than assuming that only people on the proprietor's direct payroll count.
Keep the assessment date and relevant historical period clear. A site that expanded recently may have a different position before and after additional workers or processes arrived. A photograph taken on a quiet day is not enough to establish its normal or historical operation.
Where an office genuinely operates at a separate address from a manufacturing unit, document that separation and connection honestly. State who controls each location, where employees work and what records and activities remain at each. Do not assume that a head-office certificate covers the workshop, or that a factory record automatically settles a remote administrative office.
Account for the current Uttarakhand Shops changes
The State's April 2026 Amendment Act, Act 6 of 2026, replaces ten with twenty in the Shops Act's application clause. It comes into force at once and repeals the December 2025 amendment ordinance while saving actions taken under it.
That current scope must be read alongside older forms and descriptions still referring to ten. An otherwise relevant business activity does not automatically produce the same registration duty at every workforce level. Equally, a below-threshold conclusion under the Shops Act does not answer the separate Code analysis.
The 2022 amendment and Rules should also be read in their proper context. A compiled text that notes a commencement issue is not a reason to assume every inserted provision operated from its title year. For this classification exercise, rely on the actual definitions and obtain the current filing direction where older procedural wording does not match the amended scope.
Do not use a change in threshold as a reason to alter old records privately or discard evidence of earlier coverage. Keep a short chronology of the relevant activity, worker levels and legal changes.
Distinguish actual notifications from their webpage labels
The department's March 2026 document collection includes the earlier amendment ordinance and a clarification concerning round-the-clock opening. Permission concerning opening hours does not decide whether a workshop is a factory or prove that employee working-time requirements have disappeared.
The July 2026 OSH notification appoints registering officers and other authorities. It is an administrative implementation instrument, not a complete final set of State OSH rules. The May 2026 proposed State rules must not be treated as final merely because they are available online.
For the mixed site, use the appointed authority relevant to its activity and territory. The July notification distinguishes factory establishments from other establishment categories. A classification request should identify the exact district and premises so the department can direct it correctly.
Where an existing certificate carries a predecessor-law label, preserve it and explain the transition. An older service heading does not itself settle which current provisions govern the operation.
Prepare a classification request that can be answered
An effective request should contain enough facts for a reasoned response. Include the employer's identity, complete premises address, site layout, activities, processes, equipment, power use, workforce and existing registrations. Attach a concise process description and relevant photographs.
Ask a concrete question: whether the described mixed premises fall within the Shops classification, the factory framework or another applicable arrangement, and what registration or amendment is required. If different portions require different treatment, ask the authority to identify the basis and record boundaries.
Avoid asking only “Which licence do we need?” without explaining the operations. Also avoid presenting a preferred conclusion as fact: “No manufacturing is done” is not useful if attached job cards show regular repair and processing.
Keep the response and the facts on which it was based. A direction about a small repair facility should be reviewed if powered machinery, processes, headcount or premises later change. An accurate original opinion can become unsuitable after operational expansion.
Use amendment when an existing record no longer matches
The 2022 Rules provide for online registration in Form A and a certificate in Form B. Their change procedure uses Form G, with notice within thirty days and supporting documents. These procedural descriptions must be applied with current legislation and any later directions affecting the establishment.
If the business adds a store or workshop, identify whether it changes the recorded activity, address, extent of premises or another particular. Do not treat the purchase of a new machine as merely an accounting entry if it changes how the site operates.
The complete application must describe reality even if the portal offers only broad categories. Use an explanation and seek assistance from the Facilitator where necessary. Do not choose an inaccurate classification merely because it produces a certificate faster.
Where factory-related approvals or Code registration are required, follow that separate authority's process. An amendment to a Shops certificate cannot by itself approve manufacturing activities or replace required site and safety permissions.
Two examples of the evidence-led approach
A design consultancy has office desks and a locked room for stationery, files and demonstration samples. It undertakes no work on products. Its file should explain the office service and incidental storage, then assess Shops scope and any other applicable registration. Calling the store room a “warehouse” on a lease should not alone determine the labour category.
A repair business has a reception and sales desk, a parts store and a powered processing area. Its employees move between those spaces. Its file should describe the integrated operation, process and power use, with a complete workforce and layout assessment. The front desk does not establish that the entire site is only an office.
These examples do not prescribe a result for an unidentified business. They show why activity records and premises control matter more than a short trade description.
Before changing or expanding the premises
Complete the activity map and worker reconciliation before operations change. Retrieve existing certificates and identify pending applications or notices. Obtain the appropriate classification direction where the process boundary is uncertain, and agree the required registration or amendment sequence.
Review the layout and permissions before adding machinery or converting storage into processing space. Update employee deployment and workplace arrangements as applicable. Retain the final issued documents together with the classification note so later advisers can understand the decision.
A practice using assureOffice can connect the exercise with asset purchases, business records and the client's broader compliance review. Explore assureoffice.in for related practice tools. The product should not be assumed to provide automated factory classification, statutory approval or a government filing outcome.
Frequently asked questions
1. Does a store room turn my consulting office into a shop?
The Shops definition can already include offices and connected storage. Assess the actual business and statutory scope; the mere presence of a store room does not establish a factory or settle registration eligibility.
2. Can the lease description decide the labour classification?
No. It is relevant premises evidence, but the operation must be assessed on its activities, layout, workforce and applicable definitions. Explain any difference between the lease label and actual use.
3. Can an office attached to a factory have a separate position?
Possibly, depending on the premises, functions and relevant exclusion. Do not assume every administrative office of a manufacturing company is either automatically included or automatically excluded.
4. What matters for a repair workshop that also sells products?
Describe both sides of the business, the process performed on articles, power use, staff movement and site boundaries. A sales counter should not conceal the workshop operation behind it.
5. Does adding powered machinery require a review?
Yes, where it changes the process or classification facts. Review the proposed operation before starting it rather than relying solely on an unchanged business name or existing certificate.
6. Is ordinary office electricity enough to establish a factory?
Do not reach that conclusion from electricity alone. Identify whether it aids the relevant process and assess the full statutory conditions for the actual premises.
7. Does a small workshop always fall outside the OSH Code?
No automatic conclusion follows from its size. Registration and other coverage provisions require separate assessment, including any relevant notified activity and State position.
8. Can we count only people standing at the machines?
That is not a reliable approach. Give the authority the complete site workforce and functions, including connected work, and apply the relevant statutory definition and period.
9. Should contract and part-time personnel be disclosed?
Yes. Describe the actual engagement and deployment so they can be treated correctly under the applicable law. Do not omit them merely because they are outside the direct monthly payroll.
10. Does the Shops Act currently start at ten employees?
The April 2026 amendment replaces ten with twenty in the application clause. Older forms must be read with that amendment and the relevant operating period.
11. Is being below the Shops threshold a complete exemption?
No. Other labour, Code, premises and activity-specific requirements need their own assessment. A conclusion about one State Act should not be enlarged into an all-purpose exemption.
12. Does a 24×7 opening clarification decide classification?
No. It concerns opening hours and does not determine whether the premises involve manufacturing or remove the separate requirements governing employees' work.
13. Are the July 2026 OSH notifications final State rules?
The instrument examined appoints authorities, including registering officers. Do not describe it as a complete final rules notification or treat proposed rules as operative solely because they are online.
14. Who should receive a mixed-premises question?
Identify the appropriate Labour Department authority for the activity and territory. Where a factory issue arises, provide the full file to the relevant factory-side authority as well.
15. What should accompany a classification request?
Provide identity, address, layout, process and equipment descriptions, power use, workforce deployment and existing records. Ask a specific question based on those disclosed facts.
16. Can we choose whichever portal category accepts the application?
No. The selected category and supporting declaration must be accurate. Seek assistance where the available fields do not describe a mixed operation properly.
17. How are changes to an existing Shops certificate reported?
The 2022 Rules provide a Form G change procedure with supporting documents and a thirty-day period. Apply the current requirements and preserve the resulting updated record.
18. Does a Shops amendment authorise a new manufacturing unit?
Not by itself. Determine and complete the separate permissions or registration required for the operation. One administrative change cannot substitute for another authority's approval.
19. When should an earlier classification be revisited?
Review it when processes, machinery, worker levels, premises boundaries or employer control materially change. Preserve the earlier conclusion and explain the new facts rather than rewriting history.
20. Can assureOffice determine the legal category automatically?
This guide does not assume that capability. Related accounts and practice work can support the evidence file, while the statutory classification and filing route require their own verified assessment.
