Chhattisgarh Shops LIN Application: What to Do With an Old 1958-Act Certificate

An old Chhattisgarh Shops certificate is useful evidence when completing the current Labour Identification Number application. It should not be discarded because it names the 1958 Act, or concealed by answering “No” to a question about previous registration. The first task is to connect that historical record with the same legal employer and establishment today.

An old Chhattisgarh Shops certificate is useful evidence when completing the current Labour Identification Number application. It should not be discarded because it names the 1958 Act, or concealed by answering “No” to a question about previous registration. The first task is to connect that historical record with the same legal employer and establishment today.

That does not mean every old certificate holder must submit the same new application. The current applicability threshold, the establishment's workforce history, saved earlier actions and the status of any existing LIN all matter. A portal login is also different from the statutory number issued for an establishment.

This guide is reviewed for 18 October 2026. It accounts for the commencement of the 2017 Act in February 2025, the June 2026 procedural changes and the July 2026 amendment raising the Act's applicability threshold. Older service labels and unamended passages should not be read in isolation.

Start with the certificate and the legal employer

Make a legible copy of the complete old certificate, including endorsements. Record its number, issuing authority, business name, employer, premises, issue date and stated validity. Keep receipts, amendments and any correspondence that explain later changes.

Then identify the employer now. A proprietor changing a trading name is different from a company buying the proprietor's business. A partnership admitting a partner may present different questions from a new LLP taking over operations. Do not assume that continuity of the shop sign or the same landlord establishes continuity of the legal person.

Prepare a short comparison showing the old and current position. If a discrepancy exists, state when and why it arose. A certificate for the former address or former owner may still be relevant history, but it should not be uploaded as if every detail describes the present establishment.

The establishment's commencement date should also be genuine. The date a new portal account was created is not automatically the date the business began. Preserve the historical start and explain later moves or changes separately.

Understand the legal transition before selecting the service

The Chhattisgarh Shops and Establishments Act bearing the 2017 title was enacted as Act 21 of 2018. Its appointed commencement was established through the notification dated 13 February 2025. The year in the title therefore does not mean the new scheme operated from 2017.

Section 30 repeals the 1958 Act and preserves earlier things done or actions taken insofar as they are consistent with the new law. This makes the old certificate part of the evidence trail. It does not justify declaring it worthless, or treating it as automatic proof that every current LIN requirement has been completed.

Section 5 establishes the registration and LIN structure. Its original text refers to ten workers and a six-month application period tied to commencement of the Act or the establishment coming into existence. A historical transitional period should not be described as a fresh six-month amnesty starting whenever an owner discovers the new portal.

For a delayed or unresolved legacy record, provide the facts and ask the Facilitator to identify the appropriate treatment. Do not backdate a document or change the commencement date to make the application appear timely.

Apply the July 2026 threshold change

Act 11 of 2026, although titled an amendment of 2025, came into force on publication on 8 July 2026. It substitutes twenty for ten in section 1(3), the Act's applicability provision.

The distinction matters because the original section 5 wording and older explanations can still refer to ten. Read the registration provision with the amended application clause. A generic statement that every establishment with ten workers must now obtain a LIN omits the later change.

For a business with ten to nineteen workers, distinguish earlier obligations from its current position. Do not infer that a threshold increase erases a past default, cancels an existing number automatically or authorises deletion of a live record. Seek direction where an existing application or certificate needs reconciliation.

For twenty or more workers, assess the applicable statutory count and exclusions, then complete the required current process. Exactly twenty is not below the threshold. A business should not omit contract or part-time personnel simply to produce a preferred result.

The threshold also does not settle every other labour, local-body or activity-specific obligation. Keep those separate from the question of whether this State Shops Act currently applies.

Why the application asks about the 1958 Act

The live departmental Shops application is labelled under the 2017 Act and identifies itself as Form 1 for registration of a Shops and Establishments Labour Identification Number. It expressly asks whether the establishment has registration under the 1958 Act, requests the certificate and asks for the registration number valid to the stated date.

That design provides a connection between records. It is not an instruction to hide an old certificate because the new form uses a different Act name. If the previous registration genuinely belongs to the same establishment, disclose it accurately.

If the old registration expired, was cancelled or cannot be confirmed, explain that position instead of representing it as currently valid. Where the form's yes/no selection cannot express the facts fully, obtain instructions and preserve an explanatory submission with the application.

The older EoDB service page still uses a 1958-Act label. The label is a navigation clue, not a legislative commencement instrument. Use the actual current application and applicable law to determine what is being submitted.

Separate identifiers that look similar

A portal username identifies access to an account. An application number tracks a submission. A challan number identifies payment. The State Shops LIN identifies the registered establishment under this scheme. ESI, EPF and any central labour identification record serve their own purposes.

Create an identifier list with the issuing system, number, establishment name and supporting document. This prevents an accountant from entering an ESI code into the old Shops number field or treating a payment reference as proof that a certificate has issued.

Before making a new application, search the employer's existing account and files for an issued LIN or pending submission. Ask the department to locate the record where necessary. Creating a second application because the first account is inaccessible can produce two inconsistent records for the same site.

Recovering access and correcting the establishment record are different tasks. Keep the original number in correspondence so the department can connect the history.

Reconcile the workforce instead of counting only payroll names

Prepare a dated roster showing who works at the establishment, what each person does, how they are engaged and which statutory category applies. Reconcile it with payroll, attendance, contractor deployment and employment records.

The application has distinct entries for direct or regular personnel, contract personnel, part-time personnel, Apprentices Act personnel and others. It also separately seeks information about confidential, managerial or supervisory roles. These fields should be completed truthfully rather than collapsed into a single convenient payroll total.

The Act's worker definition excludes an apprentice under the Apprentices Act. A person called a trainee in an offer letter is not necessarily such an apprentice. Verify the actual arrangement before excluding that individual from the legal count.

Similarly, a designation such as “manager” is not a complete analysis of duties. Keep evidence of the role and any applicable exclusion. The form can collect information about people even where a particular statutory provision treats them differently for coverage.

Avoid double-counting one part-time direct employee in both categories without explaining the form's intended allocation. If the fields overlap in a way that affects the total, seek the Facilitator's direction and keep a reconciled roster showing each individual once in the underlying headcount.

ESI and EPF details need their own explanation

The application asks whether the establishment is registered under ESI and EPF and requests supporting certificates where the answer is yes. Use the establishment's actual registration details, including any issue about a branch being linked to a head-office code.

The older section 5(4) provides deemed registration for establishments registered under the specified ESI or EPF framework, but its proviso still requires obtaining a LIN. It should not be reduced to “EPF means nothing further is needed.” Explain the existing registration and resolve the State record.

The central labour Codes and their transition must also be considered for the relevant current registration evidence. Do not assume that any central registration automatically substitutes for a State Shops LIN merely because both systems use similar terminology. Identify the provision or applicable direction relied on, the actual issued document and the establishment it covers.

If an older form still names predecessor Acts, disclose the available current and legacy evidence with an explanation. Never select “not registered” solely because the wording has not caught up with the document now held.

Follow the amended certificate and correction procedure

The June 2026 rules replace the certificate and amendment provisions. The current structure provides for a Form 2 LIN certificate through the web portal within twenty-four hours after receipt of the prescribed application, necessary documents and payment. It is an information-based certificate founded on the employer's declaration.

This does not remove responsibility for the facts. Download the issued document and check the legal employer, address, category, commencement and workforce particulars. A system-generated certificate should not be treated as an authority finding that every factual statement was independently verified.

For changes to the LIN certificate, the amended rule 5 uses an online Form 4 application with an amendment fee of ₹100 through e-challan. It covers matters including employer or partner information, worker numbers, establishment address and nature of work. Obtain the resulting amended certificate and preserve the predecessor version.

A material change of legal employer can require additional scrutiny beyond a routine spelling correction. Present the transaction and ask for the authorised treatment rather than assuming that any transfer can be achieved by replacing a name field.

The live page and the amended rules display different payment-head wording. Confirm the payment destination through the current departmental process before paying; do not choose a head by copying an old article or an unrelated challan. Save the actual demand, payment and acknowledgement together.

Missing certificates and conflicting records

If the old certificate cannot be found, search prior advisers' files, bank submissions, rent documentation, inspection papers and municipal records. Make a written request identifying the employer, premises, approximate registration period and any partial number. A clear explanation is more useful than guessing a number.

If two certificates exist, compare the employer and premises before assuming duplication. One may relate to an old location or predecessor employer. Give the authority both records and request a documented decision on correction, continuation or closure as appropriate.

If a new LIN has already issued with incorrect history, seek correction against that LIN. Do not file another fresh application with different answers to avoid explaining the first one. Preserve the error, the correction request and the final outcome so later reviewers can understand the sequence.

A migration example

A Raipur establishment has an older certificate in the same proprietor's name and now engages twenty-two people across direct, contract and part-time arrangements. Its adviser should first reconcile the actual statutory workforce and confirm identity and address continuity. The old certificate should be disclosed and linked, rather than treated as evidence of a different business merely because it names the 1958 Act.

If the business already has a LIN, the assignment may be a correction exercise. If it does not, the application should describe the historical facts and any delay accurately. A second business with fourteen workers requires a separate current-threshold assessment; the existence of the same old certificate format does not make the two assignments identical.

Frequently asked questions

1. Should I disclose a certificate naming the 1958 Act?

Yes, where it genuinely relates to the establishment. The live application expressly seeks that history. Explain discrepancies or expired status instead of presenting an inaccurate current-validity claim.

2. Does the old Act name make the certificate useless?

No. It can establish previous registration and help connect records. Its current effect must be assessed with the savings provision, present facts and the LIN process.

3. Did the 2017 Act start operating in 2017?

No. The appointed commencement was established by the notification dated 13 February 2025. Distinguish the title year, enactment and commencement when reconstructing obligations.

4. Is ten workers still the current applicability threshold?

The July 2026 amendment raises section 1(3)'s threshold to twenty. Read older references to ten with that amendment and distinguish earlier periods from the present position.

5. Does a threshold increase cancel an existing LIN?

Do not assume automatic cancellation. Ask how the existing record should be maintained or resolved and retain the authority's response with the workforce history.

6. Is a State Shops LIN the same as a portal login?

No. The login provides account access; the LIN is an establishment identifier. Keep usernames, application references, challans and issued statutory numbers separately labelled.

7. What if I cannot find the old number?

Search earlier records and request a departmental record search using the employer and premises details. Do not invent a number or create a duplicate merely to bypass the missing history.

8. Should contract workers be ignored because another firm pays them?

No automatic exclusion follows from the payroll arrangement. The form separately asks for contract personnel. Assess the statutory definition and actual deployment before preparing the count.

9. Do part-time people belong in the application?

The live form contains a separate part-time field. Disclose them accurately and resolve any overlap with direct-worker fields without double-counting the underlying individuals.

10. Can every trainee be excluded as an apprentice?

No. Verify whether the person is an apprentice under the Apprentices Act. A convenient job title does not establish that statutory position.

11. Is a managerial title enough to exclude someone?

Do not rely on the title alone. Record the actual role and applicable legal treatment, and complete the separate managerial or supervisory information requested by the form.

12. Does EPF registration remove every LIN step?

No. The section 5 deemed-registration provision includes a LIN requirement. Provide the actual supporting registration and obtain direction for the State establishment record.

13. Can a central labour number be entered as the old Shops number?

Only if the field and authority actually require that identifier. Different systems issue different numbers; preserve a labelled list and avoid substituting one for another.

14. How quickly does the amended rule provide for the certificate?

It provides for issue within twenty-four hours after receipt of the required application, documents and fee. An incomplete draft is not the same as a complete submitted application.

15. Must a system-generated certificate have a physical signature?

The amended certificate format does not require a physical signature. Retain the issued electronic record and verify its details rather than adding a signature privately.

16. What is the current LIN amendment route?

Amended rule 5 provides an online Form 4 application with the ₹100 amendment payment. Explain material identity or ownership changes instead of assuming every case is a minor correction.

17. Should we use today's date as business commencement?

Not if the establishment began earlier. State the genuine history and explain the present application or migration separately, including any delay requiring attention.

18. Does a new LIN clear all previous defaults?

Do not assume that result. Registration of current particulars and resolution of an earlier failure or notice are separate questions requiring their own treatment.

19. What if the service index still says 1958 Act?

Treat the label as a navigation issue. Check the actual current form and law; an older webpage heading cannot determine statutory commencement or restore a repealed scheme.

20. What should the adviser retain after completion?

Keep the old certificate, identity and premises comparison, workforce reconciliation, submitted application, payment, correspondence and final LIN together. assureOffice's broader practice context does not replace that statutory evidence trail.
