PSARA Licence in West Bengal: Adding Districts, Opening Branches and Taking Out-of-State Contracts

A private security agency should compare every proposed client location with the territory written in its PSARA licence before promising deployment. An office address, company registration and security-services contract do not expand that territory. A West Bengal licence also does not become an all-India licence because the agency serves a national client.

A private security agency should compare every proposed client location with the territory written in its PSARA licence before promising deployment. An office address, company registration and security-services contract do not expand that territory. A West Bengal licence also does not become an all-India licence because the agency serves a national client.

Within West Bengal, a licence can cover one district, a group of districts or the whole State. The issued certificate and conditions determine the agency's actual position. Opening a branch in another district and obtaining permission to provide security services there are related but separate tasks.

The current State framework is the West Bengal Private Security Agencies (Regulations) Rules, 2024, published on 8 March 2025. The title year should not be mistaken for the commencement date, and the superseded 2007 rules should not be used as the default application checklist in October 2026.

Read the licence in four parts

Record the legal licensee, permitted business name, licensed territory and validity. Obtain the actual certificate and any subsequent amendment orders. A tender folder containing an old certificate does not show the current position if the agency has since changed management, address or territorial coverage.

The following comparison is a useful recommended control:

Proposed change Question to resolve
New client in an already licensed district Whether the existing permission and operating conditions cover the service
New client in an unlisted West Bengal district Territorial expansion before deployment
New branch within licensed territory Premises and particulars update, with required verification
New office in an unlicensed district Both office facts and territorial permission
Client site in another State Licence under that State's regime
Contract placed with a different group company Whether that company is itself the licensed provider

Keep district boundaries accurate. A postal address using Kolkata does not necessarily identify the relevant administrative district. Record the client site's full address and district rather than inferring coverage from the nearest major city.

Territorial bands and fees

The central Act provides application fees of ₹5,000 for one district, ₹10,000 for two to five districts and ₹25,000 for the whole State. These are territorial application bands, not a per-guard charge and not an all-India fee. A six-district expansion should not be priced as an unlimited extension of the two-to-five band.

For an existing licence, do not assume that paying the arithmetic difference between two bands automatically grants expansion. Submit the proposed additional territory to the Controlling Authority through the prescribed current process and obtain the relevant permission. The authority should confirm the appropriate transaction and fee treatment for the existing certificate.

Prepare the expansion request with the licence number, current districts, proposed districts, office arrangements and proposed services. Identify whether the agency seeks specified additional districts or statewide coverage. Keep the application, payment and resulting order together so the deployment team can establish what changed and when.

A pending application is not territorial approval. The State rules provide an application decision process; they do not make a client's desired mobilisation date a substitute for permission. Build enough time for scrutiny and police verification where required.

Use the current West Bengal authority and portal

The Controlling Authority operates through the Home and Hill Affairs Department's Internal Security Branch. The current West Bengal private-security-agency portal supports new applications, existing-licensee profiles, renewals and compliance records. Existing licence holders are directed to create their online profile using their existing licence details.

Do not create a fresh commercial identity merely because an agency's older licence was issued through an earlier workflow. Reconcile the existing record and portal profile first. Keep the authorised email and mobile number under the agency's control so that an employee or consultant's departure does not block access.

The State rules use Form I for grant or renewal, Form II for applicant antecedent information, Form III for the affidavit and Form IV for the licence. The official Home Department page also publishes fresh and renewal checklists. Use the checklist for the correct transaction and preserve the version used in the file.

Where the portal does not show a distinct territorial-expansion option, seek written instructions from the Controlling Authority with the existing certificate attached. Do not improvise a renewal application that silently changes districts or claim that updating a general profile is equivalent to an amended licence. The outcome must clearly authorise the requested territory.

Branch premises and management changes

The 2024 rules provide for verification of the agency's premises at the address or addresses supplied. Prepare lawful possession evidence and accurate office particulars. A virtual or correspondence address should not be represented as an operating office if it does not reflect the actual arrangement.

The rules require information about changes in addresses of persons forming the agency or management to be given within thirty days. Identify the actual change date and the documents supporting it. A new director or partner can also affect the antecedent and eligibility information behind the licence, so address those matters rather than sending a bare company-master-data printout.

The office-location question should be raised separately from the district service question. A branch can help administer guards in an already licensed area; it does not grant the agency permission to supply guards in an additional district. Conversely, a statewide licence does not excuse inaccurate office records or management disclosures.

Use a change memorandum stating what remains the same and what has changed: licensee, constitution, ownership, responsible persons, premises and territory. Where the legal licensee changes, do not assume that an old company's licence follows the assets or trade name. Obtain a determination of the correct application route before the new entity supplies security personnel.

Eligibility, verification and training remain part of expansion

A wider service area does not relax agency eligibility. Check the legal entity and persons behind it against the Act's conditions, including the relevant citizenship and disqualification provisions. A company registration certificate is only one part of that examination.

The State application framework requires antecedent material for the relevant proprietor, majority shareholder, partners or directors and permits inquiries and police reporting. Provide full addresses and history accurately. Do not conceal a management change because the new person's details might delay a client's start date.

Agency-level and guard-level training are separate. The State rules require the licensee's prescribed training and regulate the training of guards and supervisors. A training-provider agreement alone is not evidence that the specific guards selected for the new contract completed their required training.

Prepare guard eligibility, character-verification, training and identity-card records before deployment. Assess the current validity and acceptable form of each record with the applicable rules and directions. Do not assume that an informal police receipt is the completed verification result or that a prior employer's file can be reused without checking its legal status.

Supervision also needs practical planning. Dispersed client sites may require more supervisors than a single-site headcount suggests. The service plan should show how guards receive assistance, instructions and supervision in the new districts, rather than merely naming a supervisor at the head office.

Contracts should reflect the permission sequence

A commercial contract can specify that deployment starts only after the required licence or territorial permission is in place. That is often a sensible recommended allocation of timing risk. Do not promise that a signed contract itself creates a right to operate outside the licensed area.

Provide the client with the correct licensee's current certificate and the relevant territory evidence. If a different agency will supply services temporarily, assess that arrangement honestly, including who employs, deploys and supervises the guards. Lending another company's licence number does not make an unlicensed provider compliant.

Facilities-management businesses should classify the actual work. Calling guards housekeeping personnel does not remove PSARA where the business supplies private security services. A mixed contract can contain cleaning, reception and security components with different legal requirements.

Armed security introduces additional questions. A PSARA licence is not an arms licence and does not confer police powers. Keep the appropriate arms, training and deployment assessment separate from ordinary territorial licensing.

Another State needs another licensing project

For a contract outside West Bengal, identify the destination State or Union territory, the exact sites, the operating entity and proposed office arrangements. Obtain the licence required under that jurisdiction from its Controlling Authority. The existing West Bengal certificate is useful background evidence, not the destination permission.

Use the destination State's operative rules and checklist. Forms, training recognition, verification procedure and local documentation can differ. A completed West Bengal file can supply factual information, but its affidavit or portal upload should not be assumed to satisfy every requirement elsewhere.

If the client has sites in several States, maintain a State-and-site permission matrix. Allocate each site to the legal service provider and appropriate licence. This is a recommended contract-management control that prevents a national master agreement from hiding a local authorisation gap.

A West Bengal statewide licence still needs renewal. The standard licence period is five years, and renewal should be applied for at least forty-five days before expiry. Track territory expansion and renewal separately; an expansion request should not cause the agency to miss the renewal deadline for its existing business.

Current compliance and a final deployment check

The 2026 central amendment omitted section 12's exhibition provision and section 20(2). That change should not be described as abolition of PSARA licensing, guard eligibility, training or territorial limits. West Bengal's current rules contain their own licence-display condition, so do not infer that every display requirement vanished with the central provision.

Maintain the prescribed electronic Form X particulars and current identity-card records. The State portal explicitly supports Form X submission or updating. A client-site register should agree with actual deployment, customers and duty locations.

Before mobilisation, reconcile the licence, territory order, management record, premises information, guard files, supervision and client contract. Record any condition that remains outstanding and give the deployment manager the final approved position. assureOffice can support the surrounding financial and practice administration; security licensing and operational assessments remain specialist work. Information at assureoffice.in should not be read as a promise of a PSARA filing or guard-verification service.

Frequently asked questions

1. Can a West Bengal licence be used in another State?

It does not automatically authorise operations elsewhere. Apply under the destination State or Union territory's regime and obtain the appropriate permission before supplying security services there.

2. Does a licence always cover all West Bengal districts?

No. It may cover one district, specified districts or the whole State. Read the actual certificate and amendment orders rather than relying on a salesperson's description of the agency's reach.

3. Does opening a branch expand licensed territory?

No automatic expansion follows. A branch changes premises facts, while supplying services in additional districts requires appropriate territorial permission. Address both matters where they arise together.

4. What are the territorial application fees?

The Act prescribes ₹5,000 for one district, ₹10,000 for two to five districts and ₹25,000 for the whole State. Confirm the proper transaction treatment for an existing licence seeking expansion.

5. Can the difference in fee simply be paid to add districts?

Do not assume payment alone is enough. Obtain the Controlling Authority's prescribed process and the resulting permission clearly identifying the expanded area.

6. Who grants the West Bengal permission?

The State's Controlling Authority grants the licence under the Act. The Home and Hill Affairs Department's Internal Security Branch and current State portal provide the relevant official route.

7. Must an existing licensee register on the new portal?

The current portal directs existing holders to submit their existing licence details to create a profile. Reconcile the old record rather than assuming a fresh account creates a new licence.

8. What if there is no obvious expansion button?

Send the authority a documented request with the current and proposed territory. Obtain the correct transaction instructions instead of treating a profile edit or ordinary renewal as automatic territorial approval.

9. Can a client contract be signed before permission is granted?

A contract can make mobilisation conditional on obtaining permission. The contract itself does not authorise deployment outside the existing territory, so distinguish signing from actual supply of security services.

10. What happens when directors or partners change?

Review management disclosure, antecedent and eligibility requirements. The State rules require the relevant change information within thirty days; do not assume company filings automatically update the PSARA authority.

11. Does the 2024 title mean the new rules started in 2024?

No. They were published on 8 March 2025 and commence on Gazette publication. Use the operative rules rather than inferring commencement from the title year.

12. Do the 2007 State rules remain the default checklist?

The 2024 rules superseded them subject to the stated saving for earlier matters. Use current official checklists and explain the history where an old licence or pending matter is involved.

13. Does a training agreement prove every guard is trained?

No. Keep evidence for the individual guards and supervisors assigned to the contract. An institutional arrangement and completed personal training are different compliance facts.

14. Can guards be deployed while verification is only requested?

Do not treat a request receipt as the completed required verification. Determine the acceptable current records and complete the eligibility and verification requirements before relying on the person for deployment.

15. Is a PSARA licence an arms licence?

No. Armed deployment needs its own assessment of applicable arms and related requirements. The agency licence also does not give guards the powers of police officers.

16. Can a facilities-management company avoid PSARA by changing job titles?

No. Classify the actual services. Supplying private security remains a security activity even when the contract also includes cleaning, reception or other facilities work.

17. Is a licence number transferable to a new company?

Do not assume so. A different legal operator must establish its own lawful permission position. Asset transfers and common branding do not automatically move the old company's statutory authorisation.

18. When should renewal be applied for?

Apply at least forty-five days before the existing licence expires. Keep the actual five-year validity record and do not confuse a district-expansion project with renewal of the underlying licence.

19. Did the 2026 amendment abolish licensing or all display duties?

No. It made specific omissions in the central Act. The licensing framework continues, and the current West Bengal rules contain a separate display condition that needs to be considered.

20. What should the deployment file prove?

It should establish the correct operator, licensed district, current certificate, required staff records and workable supervision. Add the authority's expansion order before mobilising at any site outside the previously permitted area.
