No. A private security agency’s PSARA licence and Maharashtra Security Guards Board compliance answer different questions. The licence concerns the agency’s authority to conduct its regulated business. The State welfare framework can separately govern the guards, agency and principal employer at the premises concerned.
A principal employer should therefore ask for more than a licence and a promise that all labour laws are complied with. It needs a location assessment, the relevant Board and scheme, registration evidence and, where an exemption is claimed, the actual exemption instrument covering the guards and deployment.
The State Act remains a separate specialist framework. Labour Code implementation should not be treated as automatically cancelling the Security Guards Act or converting every agency licence into a welfare-board exemption.
Identify the premises and actual security arrangement
Start with the address, district, nature of the establishment and proposed deployment. Determine the applicable territorial notification and Board. A board operating in one district should not automatically be assumed to administer every site in Maharashtra.
The State’s legislation and implementation history include different territorial extensions and Boards. Use the current legal area, not only a postal city label or an old district name. Where the site lies close to a boundary, retain the address evidence and obtain confirmation of jurisdiction before registering with the wrong body.
Describe whether guards are Board-allotted, employed by an agency or claimed to be directly employed. A direct-employment position requires the real relationship and relevant statutory definition; it should not be manufactured by paying one allowance directly while the agency continues to recruit and control the guards.
The 2025 State amendment updates the establishment definition by reference to the Maharashtra Shops and Establishments legislation and changes several administrative provisions. An old brochure is therefore not the complete current Act. Examine the amended text before concluding that a modern office or commercial premises falls outside the framework.
Keep the three principal documents separate
Use a document matrix:
| Document | What it can establish | What it does not automatically establish |
|---|---|---|
| PSARA licence | Agency licensing status within its scope and validity | Security Guards Act exemption |
| Board registration | The registered person or entity and relevant status | Coverage of every new site or substituted guard |
| Gazette exemption | Exemption of the specified guards or classes on stated terms | Permanent exemption for every worker of the agency |
Read the legal entity names carefully. A licence issued to one company is not the licence of another company using the same brand. Similarly, an exemption or registration number should be matched to the actual contracting agency and deployed guards.
Check validity dates, territorial scope and conditions. Keep the complete instrument and annexures. A cropped first page may omit the guard list, excluded site or expiry provision needed for the assessment.
An exemption is conditional and person-specific in scope
Section 23 permits a government-notified exemption concerning specified guards or classes where the statutory conditions are met, including the comparison of benefits. It is not a self-declared option. An application awaiting approval does not equal an issued exemption.
Read the notification for the agency, class of guards, establishments, period and conditions. Match it to the deployment list. If an annexure names guards, a replacement worker should not be assumed covered merely because the agency says the new worker takes the old worker’s place.
The State can rescind an exemption. Monitor the instrument and any later withdrawal or amendment, rather than place it permanently in an approved-vendor folder. The 2025 amendment also addresses government action where the Advisory Committee is not functional; a generic statement that no exemption can exist without the older consultation sequence may therefore be incomplete.
Exemption from some provisions does not necessarily mean exemption from registration or every obligation. Under the relevant scheme, principal employers engaging exempted agency guards still have registration duties, and the employer agency also has its prescribed registration process. Identify the retained duties from the actual framework.
Examine principal-employer registration directly
The Brihan Mumbai and Thane scheme expressly addresses registration of principal employers engaging Board guards or guards of exempted agencies. The Board displays separate forms for principal employers and principal employers of exempted guards. That distinction is useful when preparing an application.
For a business beginning operations, the scheme contains a one-month registration provision from commencement of business. The agency’s exemption-related registration has a different fifteen-day provision tied to publication of the exemption notification. Do not use one deadline for both entities or calculate it from the first invoice without checking the legal trigger.
These are scheme-specific procedural facts, not a claim that every Maharashtra Board uses the same form or office process. Obtain the current receiving instructions and form from the relevant Board. Confirm any later fee or procedural order before payment.
Keep the submitted application, supporting documents, registration communication and correction requests. A courier receipt proves delivery of a package, not necessarily completion of registration. Do not describe the process as approved while a material query remains unanswered.
Match individual guards to the approved arrangement
Maintain an accurate deployment list with the guard’s identifier, employer, site, role, start and end dates and relevant Board or exemption reference. Link attendance and replacement records to that list.
Ask the agency to identify substitutions before deployment. An emergency replacement still needs assessment; it should not disappear from the records because it worked only one shift. Preserve the actual identity and period rather than continue billing under the absent guard’s name.
The scheme places obligations on employer agencies concerning lists of principal employers, guards and wage and benefit records. A principal employer should seek proportionate evidence that its actual deployment is reflected. A generic list of the agency’s total workforce does not identify which guards worked at the site.
Do not retain original identity documents as leverage. Verify the required status and obtain lawful copies or references where necessary. Separate sensitive personal records from the general procurement comparison sent to multiple departments.
Apply the correct current wage and levy order
Board wages and levy are not a universal Maharashtra security-agency rate card. Identify the Board, registered category, period and covered arrangement before using an amount.
A concrete example is the Brihan Mumbai and Thane Board’s 11 August 2026 order for registered Board guards and officers for 1 July–31 December 2026. For the security guard or lady searcher category, its table shows:
| Component | Monthly amount in that order |
|---|---|
| Basic wages | ₹13,457 |
| Special allowance/DA | ₹4,134 |
| HRA | ₹3,518 |
| Conveyance allowance | ₹2,200 |
| Washing allowance | ₹1,300 |
| Total wages and allowances | ₹24,609 |
| Listed levy | ₹7,978 |
| Listed total including levy | ₹32,587 |
The order uses a 45.35% levy on basic wages plus special allowance/DA and provides for remittance by the fourth day of the following month. Its wage statement concerns eight hours’ duty per day inclusive of the weekly-off arrangement and separately addresses extra duty. It should not be used to justify twelve-hour deployment at an ordinary eight-hour price.
These figures illustrate the need for an actual current Board order. They are not automatically the statutory wage bill for an exempted agency guard, another category or a Pune, Nashik or other Board deployment. Apply that arrangement’s own wage, benefit and exemption requirements.
Reconcile wages, levy and worker benefit evidence
For Board-allotted guards, match the deployment and attendance to the Board demand, payment and acknowledgement. For exempted agency guards, assess the wage and welfare evidence required by the exemption and retained scheme duties. Do not ask only whether the agency invoice was paid.
Reconcile the number of guards, category, duty days, extra duty, wage components and applicable levy base. An all-inclusive monthly amount can hide a missing statutory component. The levy percentage must be applied to the base identified by the order, not automatically to the invoice total.
Review contribution and benefit evidence in the correct legal framework. Older scheme text refers to predecessor labour statutes; current wage and social-security compliance needs the Labour Code transition considered. Conversely, do not assume every Board collection is duplicated or cancelled merely because another statutory payment exists.
assureOffice can support the financial reconciliation of invoices and related practice working papers. It should not be described as filing a PSARA licence or obtaining a Board exemption; those specialist processes require their own authorised route.
Agency changes need a fresh deployment assessment
When the agency changes but guards remain, preserve their service and benefit history and determine the new employer and exemption position. The same people wearing new uniforms does not prove that the old agency’s notification follows them to the new agency.
Address the outgoing period, pending wages, levy and benefit records before closing the vendor account. Check the incoming registration and deployment arrangement before the change date. If records are missing, document the gap and obtain correction rather than create a clean opening balance that conceals it.
Monitor expiry of licences and exemptions and changes in site, entity or workforce. Recommended contract controls include prompt notice of regulatory changes, guard substitutions and demands from the Board, together with access to relevant compliance evidence.
A vendor undertaking is useful as a contractual promise, but it is not the statutory instrument. The principal employer needs its own reviewed evidence and action record. Related documents at assureoffice.in can support that review without replacing the actual licensing and welfare-board assessment.
Frequently asked questions
1. Does a PSARA licence prove Security Guards Board compliance?
No. Licensing and the State welfare framework are separate. Check the relevant Board, scheme, registration and any exemption. A valid licence should be part of the file, not the sole legal basis for approving deployment.
2. Does Labour Code implementation automatically repeal this State framework?
Do not assume so. The Security Guards Act is a separate State enactment. Review its current text and applicable notifications alongside the Codes. An agency should identify an actual legal exemption rather than rely on a general reform announcement.
3. How is the correct Board identified?
Use the actual premises and applicable territorial notification and scheme. District and commercial city descriptions can differ. Obtain clarification where the boundary or scheme is uncertain and retain the basis for the jurisdiction selected.
4. Does one registration cover every company in a group?
Not automatically. Match the registered legal person, premises and arrangement to the actual deployment. A group brand or common procurement team does not establish that every separate entity has completed its own applicable obligations.
5. Can an exemption application be treated as approval?
No. Obtain the issued Gazette notification and its annexures and conditions. A pending application or agency assurance does not establish that the proposed guards are exempt from the provisions being relied on.
6. Does an exemption last forever?
Read its stated period and conditions and check later amendments or rescission. The statutory power allows withdrawal through the appropriate notification. An old approved-vendor entry should not replace current verification.
7. Does exemption remove principal-employer registration?
Not necessarily. The relevant scheme expressly requires registration for principal employers engaging exempted agency guards. Identify the retained duties rather than assume that exemption from specified provisions removes the entire framework.
8. Should the agency and principal employer use the same deadline?
No. Their legal triggers differ. The relevant scheme includes a new-business principal-employer provision and an agency exemption-notification provision. Confirm the current applicable procedure instead of counting from a convenient shared invoice date.
9. Can the agency provide any substitute guard?
Check the substitution against the actual registration and exemption scope. A named-guard or class-based notification may require further action. Preserve the replacement’s identity and deployment rather than billing under the original guard’s name.
10. Are directly employed guards treated identically to agency guards?
The statutory definition and actual employment relationship matter. Do not create a direct-employment claim through bookkeeping alone. Establish who recruits, employs, pays and controls the person and apply the relevant legal provisions.
11. Are the article’s 2026 wage figures statewide rates?
No. They are the stated Brihan Mumbai and Thane Board example for the identified registered category and July–December 2026 period. Another Board, role or exempted arrangement requires its own operative order and conditions.
12. What base does that example use for levy?
Its order specifies basic wages plus special allowance/DA for the 45.35% levy. Do not apply the percentage blindly to the entire invoice or another wage base. Use the table and applicable Board rounding or calculation instructions.
13. Can an eight-hour wage statement price twelve-hour shifts?
Not without assessing additional duty and applicable working-time requirements. The cited order expressly identifies the duty basis and extra-duty treatment. Review actual roster hours and payments rather than accepting an all-inclusive label.
14. Is paying the agency invoice enough evidence of worker payment?
No. Reconcile the invoice with relevant wage and benefit evidence for the actual guards. Payment to a vendor does not itself prove that the workers received correct wages or the relevant Board received its dues.
15. Does the listed Board total include every possible site cost?
Do not assume so. The table gives wages, allowances and levy within its scope. Commercial charges, tax and other matters need separate analysis. Identify each item rather than treating the example total as a universal contract price.
16. What if the agency changes while the guards remain?
Assess the new employer, registration and exemption and preserve service and benefit history. The outgoing agency’s notification does not automatically follow the guards. Reconcile outstanding obligations for the transition period.
17. Can the principal employer rely only on an undertaking?
An undertaking is a contractual commitment, not proof of a licence, registration or exemption. Obtain and review the actual documents and relevant payment evidence. Keep a record of discrepancies and how they were resolved.
18. What changed in the State Act in 2025?
The enacted amendment updates the establishment definition and certain registration and administrative powers, among other matters. Use the amended Act. Do not treat the amendment as a general exemption for all commercial offices or security agencies.
19. Should original guard identity documents be retained?
Do not hold original personal documents as security for compliance. Obtain proportionate verification evidence and protect sensitive copies. The business needs a reliable deployment record, not control over a worker’s ability to use personal documents elsewhere.
20. What should be approved before guards start work?
Approve the premises and Board assessment, agency licence, applicable registration or exemption, individual deployment list and current wage and levy basis. Assign owners for substitutions, payments and expiry reviews so the evidence remains accurate after the first day.
